Rent Determination and Rent Adjustment Lawsuits in Antalya

A dispute about the amount of rent does not always require the same legal remedy. Under Turkish law, an action for determination of rent and an action for adjustment of rent are distinct proceedings with different legal grounds, conditions and evidentiary requirements.

What Is a Rent Determination Lawsuit in Turkey?

A rent determination lawsuit is a judicial proceeding in which the court determines the rent payable for the relevant rental period according to the statutory rules. It is particularly important in residential and roofed commercial leases where the parties cannot agree on the rent to apply in a renewed period.

The court's assessment depends substantially on how long the lease relationship has continued. A case concerning an early renewal period is not evaluated in the same way as a lease that has continued for more than five years.

A rent determination case is not simply a claim asking the court to substitute the landlord's preferred market figure for the existing rent. The court must apply the criteria prescribed by Article 344.

Rent determination proceedings are frequently initiated by landlords seeking a judicially determined rent for a new rental period. However, the legal mechanism is not conceptually limited to landlords. A tenant may also have a legal interest in obtaining judicial determination where there is a genuine dispute concerning the rent payable under the statutory framework.

Before filing, the lease, existing rent-increase clause, commencement date, renewal periods and previous payments should be examined to determine whether a determination action is the appropriate remedy.

Why Is the Five-Year Period Important in a Rent Determination Case?

Article 344 makes an important distinction for leases that have continued for more than five years or have been renewed after five years. At that stage, the court may determine the new rent by considering several statutory factors together rather than looking only at the ordinary annual increase mechanism.

The court considers the twelve-month average change in the consumer price index, the condition of the leased property, comparable rents and principles of equity. The objective is a judicially determined rent appropriate to the particular lease and property.

How Does the Court Determine the Appropriate Rent?

The court does not determine market rent solely from online property advertisements or from one nearby lease. The property itself and genuinely comparable rental evidence must be evaluated together.

In practice, factors that may become relevant include the neighbourhood, exact location, property type, floor area, age, floor level, physical condition, permitted use, commercial characteristics where applicable, facilities and the dates and terms of comparable leases.

Expert examination may play an important role where the court requires a technical assessment of the property and comparable rents.

Practical review: I distinguish asking prices from evidence capable of showing an actual comparable rental relationship. A property advertised at a particular amount does not necessarily prove that the same amount represents the judicially appropriate rent for the disputed premises.

When Does a Judicially Determined Rent Become Effective?

Article 345 states that a rent determination lawsuit may be filed at any time. However, whether the amount determined by the court will bind the parties from the beginning of a particular new rental period depends on the statutory timing rules.

Where the action is filed no later than thirty days before the beginning of the new rental period, the rent determined by the court may bind the tenant from the beginning of that new period.

Article 345 also contains rules concerning a written notice sent by the landlord within that period and leases containing a contractual provision for rent increases. These rules can affect how long the action may subsequently be filed while preserving effect from the beginning of the relevant rental period.

Filing a rent determination lawsuit and determining the period from which the new rent will apply are separate questions. I therefore calculate the new rental period and Article 345 timing before proceedings are started.

What Is a Rent Adjustment Lawsuit in Turkey?

A rent adjustment lawsuit seeks adaptation of the contractual rent where extraordinary circumstances arising after the contract have fundamentally disturbed the contractual balance. The principal statutory basis is Article 138 of the Turkish Code of Obligations concerning excessive hardship.

This is different from the periodic rent-determination mechanism under Article 344. A party seeking adaptation must establish circumstances satisfying the more demanding conditions of Article 138 rather than merely showing that current market rents have changed.

Important distinction: The passage of five years is central to one part of the rent-determination regime, but it is not the statutory foundation of an Article 138 adaptation claim. Adaptation depends on a fundamental and extraordinary disruption of the contractual equilibrium.

Article 138 establishes demanding conditions for judicial adaptation. The facts of the particular contract must be assessed rather than assuming that every economic change permits a rent adjustment.
