Legal Services in Turkey for Foreign Clients
A legal matter in Turkey does not necessarily begin with a flight to Turkey. Foreign nationals, overseas property owners, international families, investors, former residents and other clients living abroad may be able to begin with remote legal assessment, document review and procedural planning before determining whether formal representation or personal attendance is required.
When I review a matter for a client outside Turkey, I first establish where the client is located, what legal process is already pending, which authority or court is involved, whether a deadline is running, what documents exist, whether a power of attorney is required and whether any part of the procedure requires the client's personal participation. The correct route depends on the specific legal matter rather than simply on the client's nationality or country of residence.

Quick Answer: Can I hire a lawyer in Turkey while living abroad?
Yes. A foreign client can obtain legal consultation in Turkey while living abroad, and depending on the matter, an attorney may be able to carry out formal legal steps under a valid power of attorney. An initial consultation and document review can often be conducted remotely.
However, remote representation does not mean that personal attendance is never required. Certain statements, identity procedures, administrative applications, hearings or transactions may require the client to participate personally. The requirement should therefore be checked for the specific proceeding before travel or formal documents are arranged.
Who May Need Legal Assistance in Turkey From Abroad?
A client may need a lawyer in Turkey even though the client no longer lives in Turkey or has never been resident here. The legal connection may arise from property, a court case, an administrative decision, a family relationship, employment, an investment, a contract, a criminal proceeding or another legal relationship governed by Turkish law.
The practical question is therefore not simply whether the client is physically present in Turkey. The more important questions are where the legal matter is pending, which law applies, what authority has jurisdiction, whether procedural deadlines are running and which acts can legally be performed through an attorney.
Property Owners and Investors
Foreign owners may need assistance with title-deed matters, property disputes, contracts, tenants, rent, eviction, co-ownership or other civil-law issues concerning assets located in Turkey.
Spouses and Family Members Living Abroad
Divorce, custody, maintenance, matrimonial property and recognition or enforcement of foreign judgments can involve parties living in different countries.
Parties to Court or Criminal Proceedings
A person who has returned home may still have an investigation, criminal case, civil lawsuit, enforcement file or other proceeding pending in Turkey.
Legal Matters Continuing After Leaving Turkey
A legal issue may continue after a tourist, employee, tenant, student, investor or former resident has left Turkey.
Can You Hire a Lawyer in Turkey From Abroad?
Yes. Physical presence in Turkey is not a prerequisite for obtaining legal advice from a Turkish attorney. A legal matter can often begin with an online consultation and the secure review of documents supplied by the client.
The first assessment should identify whether the matter is already before a court, prosecutor, administrative authority, enforcement office, mediation bureau or another institution. It is also important to establish whether an official notification has already been received, because the notification date may trigger a statutory filing or objection period.
After the initial review, it can be determined whether the next stage consists of further document collection, negotiation, a formal application, litigation, defence work, an administrative challenge or another procedure.
Important: contacting a lawyer from abroad and formally appointing a lawyer are separate matters. An initial legal consultation may begin remotely, while formal representation may require a power of attorney or another procedural formality depending on the legal matter.
Can a Lawyer Represent You in Turkey Without You Being Present?
In many proceedings, a properly authorised attorney can carry out legal acts on behalf of a client. However, the scope of representation depends on the nature of the legal proceeding and the authority contained in the power of attorney.
Procedural and Representative Work
Depending on the file, legal work may include submitting petitions, reviewing case records, attending hearings where representation is legally sufficient, communicating with authorities, conducting negotiations, following procedural deadlines and receiving certain notifications.
Personal Participation
Certain legal or administrative procedures may require personal identification, a personal statement, attendance before a competent authority, biometrics, signature formalities or another act that cannot simply be replaced by counsel.
A client should not assume either that travel to Turkey is always necessary or that it is never necessary. The correct answer depends on the exact legal procedure, the client's procedural status and the act that must be performed.
How Does a Power of Attorney Work in Turkey?
A power of attorney authorises another person, including an attorney, to perform specified legal acts on behalf of the principal. In Turkish court proceedings, the rules concerning representation through counsel are regulated, among other provisions, by Articles 71–77 of the Turkish Code of Civil Procedure.
The authority required should be considered according to the legal task. Some legal acts require express or special authority. For this reason, a generic document should not automatically be assumed to contain every authority that may become necessary in a particular case.
Before a power of attorney is issued, it is useful to identify the legal matter and the acts that may need to be performed. This can reduce the risk of discovering later that a document does not contain an authority required for the intended procedure.
How Can a Power of Attorney for Turkey Be Issued While You Are Abroad?
A client living outside Turkey may have more than one possible route, depending on nationality, country of residence, the type of transaction and the formal requirements of the institution that will use the document.
Turkish Consular Notarial Procedure
Turkish diplomatic and consular missions provide notarial services, including power-of-attorney procedures, subject to the service available at the relevant mission and the applicable appointment and identity requirements.
Document Issued Before a Foreign Notary
A power of attorney prepared before a foreign authority may require apostille or consular legalisation, and Turkish translation or additional certification may also be necessary depending on the document, country and intended legal transaction.
The correct document route should be checked before execution. Property transactions, family-law proceedings, company matters and other procedures can have different wording, photograph, certification or special-authority requirements.
What Happens to Documents Issued Outside Turkey?
Cross-border legal files frequently include documents issued by foreign courts, notaries, registries, employers, banks, public authorities or other institutions. Before such a document is relied upon in Turkey, its formal status should be checked.
Depending on the country, document type and intended use, the process may involve apostille, consular legalisation, notarisation, certified translation or production of an original or authenticated copy.
- foreign powers of attorney;
- court judgments and divorce decisions;
- birth, marriage and civil-status records;
- company and commercial documents;
- bank and financial records;
- property and ownership documents;
- employment records and contracts;
- official notifications or administrative decisions;
- other evidence originating outside Turkey.
Whether an apostille is available or sufficient depends on the country, the applicable international framework, the document and the institution before which it will be used. The formal route should be identified for the specific document rather than assumed in advance.
When Might You Need to Be Physically Present in Turkey?
A lawyer can perform many acts on behalf of a properly represented client, but some procedures may still require the client personally. This may arise because of the nature of the legal transaction, the person's procedural status or a specific decision of the competent authority.
Personal Formalities
Certain procedures require direct identity verification, a personal signature, biometric data or an appearance before a notary, consular mission or public authority.
Personal Statement or Hearing
Depending on the proceeding and procedural status, a court, prosecutor or other authority may require a person to give a statement or participate personally in a procedural act.
Applications Requiring Attendance
Some immigration, citizenship or administrative procedures may contain appointment, identity or attendance requirements that cannot be replaced simply by appointing counsel.
Special Legal Requirements
Property, company, family, banking or other transactions may be subject to additional formal requirements depending on the precise act to be completed.
Which Legal Matters May Involve Foreign Clients Living Abroad?
The fact that a client lives abroad does not create a separate branch of law. The underlying matter may still concern criminal law, family law, immigration, employment, tenancy, property or another area of Turkish law. The cross-border element changes how documents, communication, representation and personal attendance may need to be organised.
Criminal Proceedings in Turkey
Assistance may concern investigations, prosecutor proceedings, criminal trials, detention or judicial-control issues, evidence, appeals and other criminal-procedure questions involving foreign nationals.
Immigration and Administrative Matters
Residence permits, work permits, citizenship, deportation decisions, administrative detention, entry restrictions and related administrative procedures may require urgent review of the decision and notification date.
Divorce and Family Law
Cross-border family matters may involve spouses living in different countries, children abroad, matrimonial property, maintenance, custody or recognition and enforcement of foreign court judgments.
Employment and Labour Disputes
Employment contracts, termination, unpaid wages, severance and notice pay, reinstatement, mediation and other labour-law matters may continue after a foreign employee leaves Turkey.
Property Owners, Landlords and Tenants
Overseas owners may require legal assessment concerning leases, rent disputes, eviction, contracts, title-deed issues, co-ownership or other property-related legal matters in Turkey.

Working With a Turkish Attorney While You Are Abroad

Understanding the Turkish Procedure From Another Country
Distance can make an unfamiliar legal system more difficult to follow. A client may receive a Turkish court paper, administrative decision, contract or official notice without immediately understanding its legal effect.
English-language communication can be used to explain the procedural stage, relevant documents, important deadlines, available legal options and the next steps that may need to be considered.
Formal proceedings in Turkey remain subject to the applicable Turkish-language and procedural requirements. Where an official interpreter or certified translation is legally necessary, English communication with counsel does not replace that formal requirement.
How Can Legal Assistance in Turkey Begin From Abroad?
Identify the Legal Matter
The first step is to establish what happened, where the matter is pending, the client's current location and what result or legal issue requires assessment.
Check Urgent Dates and Notifications
Court papers, administrative decisions, criminal-procedure documents and formal notices are reviewed to determine whether a statutory deadline or scheduled procedural event is approaching.
Review the Available Documents
Relevant contracts, official papers, judgments, correspondence, identity records, property documents and other available evidence are examined.
Determine Representation Requirements
If formal representation may be appropriate, the necessary power-of-attorney wording, authentication route and any special authority are identified.
Determine Whether Personal Attendance Is Needed
The file is assessed to identify whether any current or future step requires the client to be physically present in Turkey.
Follow the Appropriate Legal Route
Depending on the matter, this may involve litigation, defence, negotiation, mediation, an administrative procedure, document preparation or another legal step under Turkish law.
What Documents Should a Foreign Client Prepare?
The documents required depend on the legal matter, but it is useful to begin with a complete chronological record rather than sending isolated documents without context.
- passport or relevant identity document;
- current contact and overseas address information;
- court papers and official notifications;
- prosecutor or police documents;
- administrative decisions and notification records;
- contracts and written agreements;
- title-deed, property or lease documents;
- employment agreements and payroll records;
- foreign court judgments or civil-status records;
- relevant emails, messages and correspondence;
- previous powers of attorney, if any;
- a short chronology showing important dates and events.
Record the date of every official notification. In many court and administrative procedures, the date on which a document was served or learned can be critical for determining the available legal remedy and deadline.

Legal Services in Turkey for Foreign Clients: FAQ
Can I hire a lawyer in Turkey while I am living abroad?
Yes. An initial legal consultation and document review can be conducted while you are outside Turkey. If formal representation is later required, the applicable power-of-attorney and procedural requirements should be determined for the specific legal matter.
Do I need to travel to Turkey to start my legal case?
Not necessarily. Many matters can begin with remote consultation and document review. Depending on the procedure, an attorney may also carry out formal steps under a valid power of attorney. Some procedures may nevertheless require personal attendance.
How can I give a power of attorney to a lawyer in Turkey from abroad?
Depending on the country and the type of legal transaction, a power of attorney may be issued through a Turkish consular notarial procedure or before a competent foreign authority. Foreign-issued documents may require apostille or legalisation, translation and other formalities before use in Turkey.
Does every foreign power of attorney need an apostille?
Not every document follows the same route. The authentication requirement depends on the country, how the document was issued, applicable international rules and the legal transaction for which it will be used. The required formalities should be checked before the document is executed.
Can I send scanned documents before sending originals?
Scanned documents may often be sufficient for an initial legal review. Formal proceedings can later require originals, certified copies, notarised translations, apostilled documents or other authenticated records depending on the matter.
Can I communicate with the attorney in English?
Yes. Attorney Cennet Kesici Çetinbaş provides English-language legal consultation and communication for foreign and international clients. Official proceedings remain subject to the applicable Turkish-language and interpretation requirements.
Can a criminal case in Turkey be followed after I return to my country?
Depending on the person's procedural status and the stage of the case, an attorney may be able to follow significant parts of a Turkish criminal proceeding. However, the competent authority may require personal participation for certain statements, hearings or procedural acts. The individual file should therefore be reviewed before assumptions are made.
Can an overseas property owner appoint a lawyer in Turkey?
Legal representation may be possible for many property-related matters, including disputes and tenancy issues. Property transactions can have specific power-of-attorney, identification and land-registry formalities, so the intended transaction should be identified before the document is prepared.
Can divorce proceedings in Turkey be handled while one spouse lives abroad?
International divorce matters may be possible before Turkish courts when the relevant jurisdictional and private-international-law requirements are met. Representation, personal participation, special power-of-attorney authority and foreign documents should be assessed according to the particular marriage and proceeding.
What should I do if I receive a Turkish court or official document abroad?
Keep the complete document and record the date on which it was received. Court papers and administrative decisions can trigger statutory deadlines. The document should be reviewed promptly to determine its legal effect, the competent authority and any available legal remedy.
Do You Have a Legal Matter in Turkey While Living Abroad?
