What Can You Do If Dental Treatment in Antalya Goes Wrong?
Depending on the agreement and the applicable legal conditions, you may be able to seek a refund, price reduction, recovery of necessary further treatment costs or compensation. These remedies are not automatically available together. Implant loss, pain or dissatisfaction alone does not establish negligence.
My first advice is to preserve your treatment plan, dental imaging, consent documents and payment records. Do not delay necessary dental care while gathering evidence for a legal assessment.
Problems after dental treatment abroad can leave you facing additional appointments, unexpected costs and uncertainty about what was originally agreed. If you have returned home, obtaining the clinic's records may become a practical priority.
I am Attorney Cennet Kesici Çetinbaş, a lawyer registered with the Antalya Bar Association. I review the planned treatment, clinical records and later developments to identify the potential claim, necessary evidence and appropriate procedure under Turkish law.

Legal advice and representation in dental treatment disputes
Scope of Legal Assistance
The work required depends on the treatment, alleged problem and stage of the dispute. Assistance may include:
- Reviewing treatment plans and package agreements
- Requesting clinical records and dental imaging
- Assessing consent and statements about the result
- Identifying the parties and legal route
- Preparing refund and further-treatment claims
- Documenting financial and non-financial harm
- Required preliminary applications and mediation
- Litigation and objections to expert reports

Implants and Other Dental Procedures
Different procedures require different records and specialist assessment. The outcome must be examined alongside the patient's initial condition, treatment plan and follow-up care.
Dental Implants
Assessment, imaging, treatment planning, placement and follow-up may be relevant. Implant loss does not, by itself, establish a treatment error.
Crowns, Bridges and Dentures
Agreed materials, fit, function and appearance are examined separately. A contractual problem may differ from a clinical negligence allegation.
Root Canal Treatment and Fillings
Diagnosis, imaging, procedure records and monitoring may be needed. Persistent symptoms or retreatment alone do not prove negligence.
Extractions and Oral Surgery
The indication for treatment, preparation, consent and postoperative care are reviewed when assessing an alleged injury or failure.
Disputes About Crowns, Bridges and Dentures
A restoration dispute should not be reduced to whether the patient is satisfied. The agreed material, clinical fit, function and aesthetic result raise different questions.
Materials and the Agreed Treatment
Quotations, treatment plans and available product or laboratory records may help establish what material was agreed and used. A different material may require examination of the information provided and any agreed change.
Appearance alone may not reliably establish the material used. Record review and technical verification may be necessary.
Fit and Function
Complaints about biting, chewing, speech or tissue irritation require clinical assessment. Adjustment visits and the provider's response should be documented.
An expected adaptation period and a problem requiring correction are not the same. The distinction should be assessed by the relevant dental specialist.
Appearance and Personal Expectations
Personal preferences about colour or shape should be distinguished from agreed specifications. Trial-stage records, photographs and correspondence may help explain what was accepted.
A digital simulation or reference image does not, by itself, guarantee an identical result. Its accompanying explanations and contractual context matter.
Negligence, Complications and Informed Consent
An unfavourable result does not automatically establish liability. The initial condition, treatment selected, clinical technique, information provided and follow-up should be examined together.
Where a complication occurred, its recognition and management may require separate review. Relevant professional standards and the cause of the harm are medical questions that may need expert evidence.
Aftercare and the Patient's Conduct
Follow-up appointments, care instructions and the patient's response may be relevant. A statement that the patient did not follow advice does not automatically resolve liability.
The advice actually given, when it was provided and its connection to the outcome should be established from the records.
Consent and Treatment Changes
The patient should receive understandable information about the intervention, significant risks, alternatives and consequences of declining it. A signed form is not a blanket waiver of responsibility for improper care.
The treatment plan and consent should be compared with the procedures performed. Changes, emergency circumstances and statutory exceptions require individual assessment.
The Dentist and the Clinic
The treating dentist, provider agreement, working arrangements and clinic's own obligations may all matter. Staffing, equipment, record-keeping and follow-up arrangements can be relevant to the claim.
For general medical liability principles, see Medical Malpractice Lawyer in Antalya.
Refunds, Further Treatment Costs and Compensation
The agreement, alleged breach and applicable legal rules determine the available remedies. Refunds, price reductions and compensation cannot simply be added together without examining their conditions.
Partly Completed Treatment Packages
Where a package includes several procedures, identify which were completed, which were not performed and which are disputed. The agreed allocation of the fee may be important.
A problem with one procedure does not automatically entitle the patient to repayment of the entire package price. However, its effect on the overall purpose of the treatment must also be considered.
The procedures' separability, contractual terms and extent of the alleged failure help determine whether the appropriate claim concerns the full fee or a particular part.
Pecuniary Compensation: Financial Loss
- Necessary dental retreatment
- Replacement implant or restoration costs
- Additional surgery and rehabilitation
- Medication and evidenced care costs
- Loss of earnings or earning capacity
- Other recoverable expenses linked to the injury
The necessity, amount and connection to the original treatment must be supported by evidence. An invoice alone does not establish that every expense is recoverable. The same loss cannot be recovered twice.
Non-Pecuniary Compensation
Non-pecuniary compensation may address physical suffering and psychological harm where the relevant legal conditions are met. Lasting impairment and effects on daily life may be relevant.
Dissatisfaction alone does not establish entitlement. The amount and outcome depend on the case; award levels from another country should not be assumed to apply in Turkey.
Further Treatment in Your Home Country
Returning home and obtaining treatment from another dentist does not, by itself, prove that the first provider was negligent. The reason for further treatment and its connection to the original procedure should be documented.
Records Before Corrective Treatment
Where feasible, preserve an assessment of the current condition, relevant imaging and photographs before corrective treatment begins. Necessary or urgent care should not be delayed for legal evidence collection.
Keep later clinical reports, treatment plans and invoices. Available information about removed or replaced materials may also assist the assessment.
Free Retreatment and Refund Offers
An offer of free retreatment does not automatically amount to an admission of liability or settle every loss. The proposal and its terms should be reviewed.
A refund document containing a release or full and final settlement clause may affect further claims. Its scope and legal effect should be understood before it is signed.
Dental Records and Expert Evidence
A timeline should connect the initial condition, planned treatment, procedures performed and later developments. Records should identify the relevant tooth or treatment area where possible.
- Examination notes and dental charts
- Panoramic and other relevant dental radiographs
- Available CBCT images and reports
- Treatment plans and procedure dates
- Consent forms and patient-information documents
- Available implant and restoration material records
- Original photographs and relevant correspondence
- Later treatment reports and payment evidence
Obtaining the Clinic's Records
Turkish patient-rights rules provide for access to relevant records and copies, subject to identity, representation and confidentiality requirements.
A patient portal or e-Nabız extract may not contain the complete clinical file. Where available, retain the original electronic imaging files and reports rather than screenshots alone.
Questions for the Dental Expert
The appropriate specialty depends on the allegation. Treatment selection, technique, materials, monitoring, complication management and the cause of the harm may require review.
The need for later treatment and its reasonable cost may also be relevant. The report should address the actual allegations and records with reasons.
Missing analysis or inconsistencies can be identified in objections within the applicable procedural deadline. The court makes the final legal determination.
Dental images, clinical records and photographs contain sensitive personal information. Share relevant documents through confidential channels rather than public comments.
Legal Routes and Deadlines
Private Dentists and Clinics
Where the relationship qualifies as a consumer transaction, Turkish consumer-law procedures may apply.
The competent body or court and any mandatory pre-action mediation depend on the claim, its value and statutory exceptions.
Public Dental Services
Claims generally involve the relevant public administration's liability and compensation proceedings before the administrative courts.
Preliminary application requirements and filing deadlines must be checked against the facts and notification dates.
Notification and Time Limits
There is no single deadline for every dental dispute. The agreement, claim, treatment date and date of knowledge may affect the analysis. Notification requirements under applicable defective-performance rules may also need consideration.
Discussions with the clinic or a disciplinary complaint should not be assumed to suspend every time limit. Complaints and compensation procedures have different purposes and requirements.
Dental Tourism and Remote Representation
Preserve the package offer, intermediary agreement, payment details and follow-up arrangements. The clinic, dentist and booking company may have different responsibilities.
An initial consultation may be possible remotely. Formal representation may require a properly issued power of attorney for foreign clients, and foreign documents may need translation or additional formalities.
English-language communication does not replace official Turkish-language requirements. Some procedures may still require attendance or a dental examination. See remote legal representation in Turkey for the practical scope and limitations.
If you have not yet instructed counsel, the guide to hiring a lawyer in Turkey from abroad explains professional verification, preparing the initial enquiry and clarifying the scope of legal work.

Frequently Asked Questions About Dental Treatment Disputes in Turkey
Does implant failure automatically prove negligence?
No. The initial condition, treatment, follow-up and other relevant factors require specialist assessment.
Can I seek a refund because I dislike the appearance of my crowns?
Personal dissatisfaction alone is not enough. The agreed specifications, actual result and conditions of the requested remedy must be examined.
Can one disputed procedure justify a refund of the whole package?
Not automatically. The agreement, allocation of the fee and effect on the overall treatment purpose must be assessed.
Can I claim the cost of retreatment in my home country?
It may be considered where the applicable conditions are met. Necessity, amount and connection to the original treatment require evidence.
Does signing a consent form prevent a claim?
Not automatically. The information provided, scope of consent and treatment must be examined.
Can I request my dental images and clinical notes?
Patient-rights rules provide for access and copies, subject to the applicable identity, representation and confidentiality requirements.
Can an unfavourable expert report be challenged?
Objections may be submitted within the applicable procedure and deadlines. Missing analysis and inconsistencies should be identified specifically.
Do discussions with the clinic stop the deadline?
Do not assume that they do. The legal basis and steps actually taken require independent deadline review.
What should I check before accepting a refund or free retreatment?
Review the offer's scope and any release or settlement terms. These may affect further claims and should be understood before signing.
Can I begin the assessment from outside Turkey?
Initial consultation and record review may be possible remotely. Representation and attendance requirements depend on the procedure.
