Drug-Related Offences in Turkey: Legal Process for Foreigners in Antalya
Drug-Related Offences in Turkey: Possession, Trafficking and the Legal Process for Foreigners
Being caught with drugs in Turkey can lead to very different legal consequences depending on whether the allegation concerns personal use or drug trafficking. For a foreign national in Antalya, the criminal investigation may also raise separate questions about detention, interpretation, residence status, deportation or future entry to Turkey. The first legal task is therefore to identify the alleged offence correctly and examine the evidence supporting that classification.
Turkish law makes a fundamental distinction between possession or use for personal consumption under TCK Article 191 and manufacture or trafficking under TCK Article 188. Article 191 has a special prosecution-deferral and probation framework. Article 188 carries substantially heavier prison sentences and may lead to proceedings before the High Criminal Court. The amount of a substance is relevant, but quantity alone does not automatically determine whether a case is classified as personal use or trafficking.
What Are the Main Drug-Related Offences Under Turkish Law?
Drug-related offences are regulated principally by the Turkish Criminal Code No. 5237.
For most foreign nationals caught with a prohibited substance, the central legal question is whether the conduct falls within:
Purchasing, accepting or possessing a narcotic or psychotropic substance for personal use, or using such a substance.
Manufacture, import, export, sale, supply, delivery, transportation, storage and other trafficking-related conduct defined by the statute.
This classification affects the possible sentence, investigative measures, detention analysis, competent court and overall defence strategy.
For case-specific criminal defence services concerning these allegations, see our Drug Offences Lawyer in Antalya page.
What Happens If Drugs Are Alleged to Be for Personal Use?
Article 191 applies to a person who purchases, accepts or possesses a narcotic or psychotropic substance for personal use or who uses such a substance.
The statutory offence carries a prison sentence of two to five years, but Article 191 establishes a special investigation procedure under which public prosecution is generally deferred for five years and probation measures are imposed.
During the five-year deferment period, the suspect is subject to probation for at least one year. That probation period may be extended in six-month periods for up to two additional years.
Where considered necessary, treatment may also be imposed. Under the current wording introduced in 2023, the prosecutor is also required to arrange referral to the relevant institution at least twice a year during the deferment period for the purpose of determining whether the suspect has used narcotic or psychotropic substances.
What Is the Penalty for Drug Trafficking in Turkey?
Article 188 treats manufacture and trafficking allegations substantially more seriously than personal use.
Manufacture, Import or Export
Unauthorised manufacture, import or export of narcotic or psychotropic substances is punishable by 20 to 30 years’ imprisonment together with a judicial fine calculated within the statutory day-based range.
Domestic Sale, Supply, Transport or Storage
Article 188 also covers a broad range of domestic trafficking conduct, including selling, offering for sale, supplying another person, transporting, forwarding, storing, purchasing, accepting or possessing a substance where the conduct falls within the trafficking provision.
The statutory prison sentence is not less than ten years, together with a judicial fine. Where drugs are sold or supplied to a child, the prison sentence cannot be less than fifteen years.
Article 188 also contains aggravating circumstances. These include certain specified substances, conduct committed near schools and certain other protected facilities, offences committed jointly by three or more persons, and offences committed within the activities of a criminal organisation.

How Do Turkish Authorities Decide Whether Drugs Were for Personal Use or Trafficking?
There is no universal rule that a particular number of grams automatically converts a personal-use allegation into drug trafficking.
The legal characterisation is made by examining the facts and evidence as a whole.
Quantity may be relevant but should not be treated as the only criterion.
Multiple individually packaged portions may be evaluated together with other evidence.
Phones and other devices may contain communications relied upon by the prosecution or defence.
Items recovered during a search may be relevant depending on their context and evidential connection.
Cash alone proves little, but unexplained financial material may be examined with the rest of the file.
Statements are evaluated together with physical, forensic and digital evidence.
What Evidence Is Important in a Drug Investigation?
Drug prosecutions often depend heavily on forensic and technical evidence.
The defence analysis should address not only what evidence exists, but also how it was obtained, whether it relates to the suspect and whether the conclusions drawn from it are legally and factually justified.
What Happens After a Foreign National Is Caught With Drugs in Antalya?
The precise process depends on the circumstances of the incident, but a criminal investigation may develop through several stages.
The substance and other relevant items may be secured and documented.
Depending on the legal basis and authorisation, investigative measures may involve a person, vehicle, residence or digital material.
Laboratory findings are important for identifying the nature and amount of the seized substance.
The suspect must be informed of procedural rights before a statement is taken.
The prosecutor evaluates the offence classification, evidence and whether additional investigative measures are required.
Depending on the allegation and evidence, measures affecting liberty may be considered separately.
What Rights Does a Foreign Suspect Have in Turkey?
A foreign national involved in a Turkish criminal investigation has fundamental procedural rights under the Code of Criminal Procedure.
These safeguards are particularly important where a foreign national cannot sufficiently understand Turkish police questions, reports or procedural documents.
Is a Defence Lawyer Mandatory in a Drug Trafficking Investigation?
Under Article 150 of the Code of Criminal Procedure, mandatory defence counsel is required in certain cases, including where the statutory minimum prison sentence for the alleged offence exceeds five years.
Because the core trafficking offences under Article 188 carry minimum sentences well above that threshold, a suspect investigated for Article 188 ordinarily falls within the mandatory-defence framework.

Article 191 personal-use allegations do not meet that penalty threshold solely by virtue of the offence’s sentence, although the suspect retains the right to legal assistance under the ordinary criminal-procedure rules.

Does a Drug Trafficking Allegation Mean Automatic Pre-Trial Detention?
No. Pre-trial detention is a protective criminal-procedure measure rather than a finding of guilt.
Drug manufacture and trafficking under Article 188 is included among the catalogue offences referred to in Article 100 of the Code of Criminal Procedure. However, catalogue status does not eliminate the requirement for a judicial assessment of the evidence and the proportionality of detention.
The court should consider the statutory detention framework, the concrete evidence, the alleged risk and whether judicial-control measures would be sufficient in the individual case.
For a more detailed explanation, see Police Custody, Pre-Trial Detention and Judicial Control Objections in Antalya .
Which Court Hears a Drug Trafficking Case in Turkey?
Article 188 trafficking cases are serious criminal proceedings and fall within the jurisdiction of the High Criminal Court (Ağır Ceza Mahkemesi) because of the statutory punishment attached to the offence.
Article 191 personal-use proceedings are legally different and should not be treated as if every drug allegation automatically becomes a High Criminal Court prosecution.
If an Article 188 prosecution is commenced, the indictment, evidence, detention position and defence are considered through the High Criminal Court procedure.
For an overview of the court structure, see High Criminal Court in Turkey: Cases and Trial Process .
What Is Effective Remorse in Turkish Drug Cases?
Article 192 contains special provisions concerning effective remorse (etkin pişmanlık) in certain drug offences.
Depending on the timing and nature of voluntary assistance, the provision can potentially result in no punishment or a reduction in punishment where the strict statutory requirements are met.
For example, the statute distinguishes between information or assistance provided before the authorities become aware of the offence and assistance provided after the offence is already known.

Can a Drug Investigation Affect a Foreigner’s Residence Permit or Immigration Status?
Potentially, yes. But the criminal case and immigration procedure are separate legal proceedings.
Under Law No. 6458 on Foreigners and International Protection, public-order or public-security considerations can become relevant to immigration measures. A residence-permit issue, removal decision, administrative detention or entry ban may therefore arise separately depending on the individual circumstances.

Determines criminal responsibility for the alleged drug-related conduct.
May concern residence status, removal, administrative detention or future entry to Turkey.
The existence of a criminal investigation does not by itself establish that a particular immigration decision will automatically follow.
If a formal removal decision has already been issued, see Deportation Order Cancellation and Stay of Execution in Antalya .
If the issue concerns future entry to Turkey, see How to Remove an Entry Ban in Turkey .
How I Review a Drug-Related Criminal File for a Foreign Client
I do not begin with the assumption that the police’s first description of the offence will necessarily be the final legal classification. The file should be reconstructed from the evidence and procedural record.
Drug Charges in Turkey: Questions From Foreign Nationals
What happens if a tourist is caught with drugs in Turkey?
A criminal investigation may be opened and the substance may be seized for forensic examination. The legal outcome depends in particular on whether the allegation is classified as personal use under TCK 191 or trafficking under TCK 188, together with the evidence and circumstances of the individual case.
Is possession of drugs for personal use a criminal offence in Turkey?
Yes. Purchasing, accepting or possessing drugs for personal use, or using them, falls within TCK 191. However, the article establishes a special five-year prosecution-deferral and probation system at the investigation stage.
Does TCK 191 always mean imprisonment?
No. Although the offence carries a statutory prison sentence, TCK 191 creates a special investigation framework involving deferment of public prosecution and probation. Compliance or non-compliance with that process is therefore legally important.
How many grams are considered drug trafficking in Turkey?
Turkish criminal law should not be reduced to one universal gram threshold. Quantity can be important, but courts and prosecutors assess the entire evidential picture, including packaging, communications, surrounding objects, statements and the circumstances of possession.
What is the minimum sentence for drug trafficking in Turkey?
For the domestic trafficking acts governed by TCK 188/3, the statutory prison sentence is not less than ten years, together with a judicial fine. Different conduct and aggravating circumstances can lead to different sentencing consequences.
Can a foreigner request an interpreter during questioning?
Yes. Where the statutory language conditions are satisfied, interpreter assistance is available in criminal proceedings. This should be distinguished from legal representation by a defence lawyer.
Do I have the right to remain silent in a Turkish drug investigation?
Yes. Under Turkish criminal procedure, a suspect must be informed of the right not to make statements concerning the alleged offence. Identity-related questions are treated separately.
Is pre-trial detention automatic for drug trafficking?
No. TCK 188 is a catalogue offence for detention purposes, but pre-trial detention remains a judicial protective measure and must be assessed under the statutory requirements and the circumstances of the individual case.
Can a drug case lead to deportation from Turkey?
Criminal proceedings may become relevant to separate immigration measures, particularly where public-order or public-security considerations arise. A criminal investigation and a removal decision are nevertheless separate legal matters and should be reviewed separately.
Can an English-speaking criminal lawyer assist a foreigner in Antalya?
Yes. Legal assistance may include review of the allegation and evidence, attendance during relevant criminal procedures, detention and judicial-control issues, court representation and assessment of connected immigration consequences where applicable.
