Can a Landlord Enter Your Rented Home Without Permission in Turkey?

Landlord & Tenant Law · Home Privacy · Antalya

Your Landlord Owns the Property. What Does That Mean for Access?

If a landlord keeps a spare key, arranges viewings or wants to inspect an apartment, a tenant may reasonably ask: can the landlord enter my rented home without permission in Turkey? Ownership does not, by itself, provide unrestricted access to a home occupied by a tenant.

When I review an access dispute, I separate the reason for the visit from the way entry was attempted. A necessary repair, an agreed viewing and an unannounced visit are different situations. The communications, consent and claimed urgency matter.

This guide explains ordinary residential access, notice, repairs, viewings, spare keys, emergencies and evidence, with practical guidance for tenants in Antalya.

Guide date: Practice area: Landlord & Tenant Law Primary legislation: Turkish Code of Obligations No. 6098 and Turkish Penal Code No. 5237
Quick Answer

Generally, a landlord cannot enter a tenant’s home at will merely because they own it or hold a key. Turkish law also requires tenants to accommodate certain necessary works and visits. These should be organised with appropriate advance notice and regard for the tenant’s interests. A genuine emergency or another lawful basis needs separate assessment.

Key Distinction Access duty is not unlimited entry A tenant’s obligation to accommodate necessary access does not give the landlord a general right to let themselves in whenever they choose.
Priority 1 Ask why access is needed and who will attend.
Priority 2 Keep the request, notice and your response in writing.
Priority 3 Offer workable arrangements for genuinely necessary access.
Priority 4 Document unexpected entry and address immediate safety concerns.

Does Property Ownership Let the Landlord Enter Whenever They Want?

Ownership and unrestricted access are different matters. A lease gives the tenant use of the property. The owner’s title does not remove the need to consider the tenant’s occupation, privacy and the legal basis for a visit.

The landlord may have a legitimate reason to request access. That reason should be identified rather than reduced to “this is my apartment”.

The same practical distinction matters when an estate agent, property manager or contractor attends. Their role does not establish unlimited permission to enter.

When Must a Tenant Accommodate Access Under Turkish Law?

Works and Necessary Visits Turkish Code of Obligations · Article 319

Article 319 requires tenants to tolerate works addressing defects or preventing damage, and to permit visits to the extent necessary for maintenance, sale or subsequent letting. The landlord must give appropriate advance notice and consider the tenant’s interests.

Source: Law No. 6098, Article 319 .

Ask what is necessary for the stated purpose. A repair inspection should be distinguishable from a general demand to examine your belongings or visit repeatedly without a clear reason.

Respond with a workable arrangement If a proposed time is unsuitable, explain why and offer realistic alternatives. An access dispute is easier to examine when the record shows cooperation with necessary visits rather than a blanket refusal.

Must the Landlord Give 24 or 48 Hours’ Notice?

Article 319 does not prescribe a universal 24-hour or 48-hour notice period. It requires notice an appropriate time in advance. The purpose, urgency, arrangements and relevant lease terms should be considered.

A rule encountered in another country should not automatically be applied to a Turkish tenancy. Equally, a short message sent immediately before arrival does not resolve whether notice was appropriate.

  • What is the purpose of the visit?
  • When will it start and how long is it expected to take?
  • Who will attend?
  • Which areas need to be accessed?
  • Is there a genuine reason for urgent attendance?
  • What alternative time can be offered if needed?

As a practical step, confirm the arrangement in writing. Notice records the request; it should not be assumed to establish consent to every proposed action.

Can the Landlord Use a Spare Key While You Are Away?

Possession of a spare key is not, by itself, permission to enter. Check what was actually agreed, for which purpose and whether it covers the particular visit.

Permission for a plumber to attend at an agreed time should not simply be treated as permission for unrelated future visits. I would examine the messages and the scope of the arrangement, rather than infer consent from the existence of a key.

Temporary Absence Travel does not explain every entry

Keep access arrangements clear when travelling for work, visiting family or spending time outside Antalya.

Specific Permission Record purpose and limits

Identify the date, attendees and task, especially if you will not be present.

Silence, an unanswered call or a general emergency contact arrangement should not automatically be treated as consent to a routine visit.

Can You Refuse Access for Repairs or Maintenance?

A tenant should not assume that every request can be refused. Necessary works and access fall within Article 319. The practical question is whether the request is justified and how it can be accommodated.

Article 318 also requires prompt notification of defects the tenant is not responsible for remedying. Report a problem clearly, keep the correspondence and discuss access needed to investigate it.

Reported Leak Organise the inspection

Ask who will attend, which area they need and whether immediate action is necessary.

Routine Work Agree practical arrangements

Discuss the time window, duration and protection of belongings in the affected area.

I would keep the access issue separate from the cost of the repair. Agreeing that a technician can inspect does not necessarily settle who must pay or what caused the problem.

Can the Landlord Bring Buyers or Prospective Tenants Into Your Home?

Article 319 includes necessary visits for sale or subsequent letting. This should be handled through proportionate arrangements, advance notice and consideration of the tenant’s interests.

Ask for scheduled time windows, expected attendees and the purpose. Suggest grouping appointments where practical rather than accepting an undefined stream of visitors.

If photographs or video are proposed, discuss them separately: clarify what will be recorded and how private belongings will be excluded. Permission to view should not be treated as resolving every privacy question about recording.

If the apartment is being sold, see My Landlord Is Selling the Property: Do I Have to Move Out? for the wider effect on the tenancy.

If viewings follow your own planned early departure, our guide to leaving a rental property early in Turkey explains notice, replacement proposals and remaining rent.

What If the Lease Says the Landlord May Inspect the Property?

Read the exact clause and the surrounding terms. An inspection provision should not automatically be interpreted as unrestricted permission to enter at any time.

I would compare its purpose, notice requirements and any agreed arrangements with the visit that actually occurred. A clause about maintenance may not answer a dispute about an unrelated entry or a visit outside the agreed scope.

Check the document, not an informal summary “The contract allows inspections” is only the start of the enquiry. Preserve the complete lease and communications explaining how the clause was used.

In a shared home, establish who occupies the property and who gave permission. Consent and its lawful purpose may require separate examination; do not assume that only the person named on the lease can be relevant.

What About Fire, a Gas Leak or Serious Flooding?

A genuine emergency is different from a convenient reason to inspect. Establish the danger, whether another response was available and whether the action was limited to what was necessary.

Article 25(2) of the Turkish Penal Code addresses necessity under conditions including serious and certain danger, absence of another means of protection and proportionality. It does not create a blanket emergency label for routine entry.

For an immediate danger, contact the appropriate emergency service through 112. Once safe, preserve reports, photographs and messages explaining what happened.

Can Unauthorised Entry Amount to a Criminal Offence?

Inviolability of the Home Turkish Penal Code · Article 116

Article 116 addresses entering a person’s home or its appurtenances against their consent, or failing to leave after entering with consent. The precise facts, consent, intent and any lawful basis need to be established.

Source: Law No. 5237, Article 116 .

Property ownership does not, alone, settle that assessment. Equally, every scheduling disagreement should not be labelled a completed offence without examining what occurred.

If threats, force, damage or refusal to leave are alleged, preserve the details separately. The basic and aggravated forms may involve different procedural considerations.

Can the Landlord Change the Locks Because Rent Is Unpaid?

A rent claim and an access dispute need separate treatment. A landlord should use the applicable legal recovery and possession procedures rather than assume unpaid rent authorises a unilateral lockout.

If you find the lock changed, record the time, photographs, communications and whether your belongings remain inside. Seek prompt assistance about access and the appropriate remedy; avoid forcing entry or escalating the confrontation.

See tenant eviction and eviction undertakings in Antalya for the relevant possession framework.

What If the Tenant Wants to Change the Lock?

A protective lock change needs consideration of the lease, the property, any alteration and eventual handover. Get advice about the specific situation rather than treating either a change or the provision of a spare key as universally required.

What Should You Do After an Unexpected Entry?

1
Address immediate safety

If there is an ongoing threat, forced entry or danger, contact 112 and give the exact address.

2
Record the chronology

Note when entry occurred, who attended, how they entered and what was said.

3
Preserve evidence

Keep relevant messages, damage photographs, access records and witness details.

4
Clarify future arrangements

Where appropriate, state your objection and propose a workable process for legitimate visits.

A later message should describe what you know without filling gaps with assumptions. If something is missing or damaged, identify the item and available evidence separately from the entry allegation.

What Evidence Helps Establish Whether Entry Was Authorised?

I would organise the file around the access request, permission, actual attendance and what followed. A lease and a photograph of the door may answer very different questions.

  • The complete lease and any access provision.
  • Requests, advance notices and appointment confirmations.
  • Messages recording permission, limits or objection.
  • Dates, times and identities of people who attended.
  • Lawfully available building or access records.
  • Original photographs of locks or alleged damage.
  • Witness contact details and relevant incident reports.
  • Repair or emergency documents relied upon to explain entry.

Preserve original files and complete relevant conversations. Ask promptly about records that may be routinely deleted. Collect evidence lawfully and avoid unnecessary recording or public disclosure of other people’s private information.

If entry is said to have revealed property damage supporting a deposit deduction, keep that claim separate. Our guide to rental deposit refunds, damage and evidence in Antalya explains that accounting issue.

An Agreed Repair Visit and a Later Unannounced Entry

Imagine a tenant who agrees that a plumber may attend on Tuesday between 10:00 and 12:00. On Friday, the landlord uses a spare key to bring a prospective buyer into the apartment while the tenant is away.

Illustrative questions for two separate visits
Event What to Examine
Tuesday repair appointment The permission, attendees, time window and work actually carried out.
Friday buyer visit The separate notice, permission, purpose and circumstances of entry.
Spare key Why it was held and whether an agreement covered the later use.
Claimed urgency Any evidence of an actual emergency rather than ordinary viewing arrangements.

I would not assume that permission for Tuesday answered every question about Friday. Each event has its own purpose and evidence.

Illustration, not a reported case This example explains the importance of scope and timing. It does not determine criminal liability or predict a court outcome.

How I Review a Landlord Entry Dispute in Antalya

I begin with the sequence of events, rather than ownership alone. I then separate a request for necessary access from the entry that actually occurred.

1. Occupation and parties I identify the rented home, occupants and people involved in the visit.
2. Purpose of access I distinguish maintenance, repairs, viewings and any claimed emergency.
3. Notice and arrangements I examine when notice was given and what appointment was proposed.
4. Consent and scope I check who gave permission, what it covered and any objection.
5. Actual entry I compare the arrangement with the timing, attendees and method of entry.
6. Supporting evidence I review communications, access records, photographs and incident reports.
7. Separate legal issues I distinguish the tenancy dispute, alleged offence, damage and any lockout.
8. Next steps I identify the appropriate remedy, deadlines and practical access arrangements.

For a foreign resident in Konyaaltı, Muratpaşa or another Antalya district, keeping a clear written record is especially useful where the lease and communications are in different languages. Preserve the original documents alongside any translations.

Frequently Asked Questions

Landlord Entry and Tenant Privacy in Turkey

Can my landlord enter my rented home without permission?

Generally, ownership alone does not permit entry at will. Necessary access obligations, actual consent, a genuine emergency or another lawful basis need separate consideration.

Can the landlord use a spare key while I am away?

Holding a spare key does not, by itself, establish permission. Check the purpose and scope of any agreement and the circumstances of the particular visit.

Is 24 hours’ notice always required in Turkey?

Article 319 does not set a universal 24-hour period. It requires appropriate advance notice and consideration of the tenant’s interests. Purpose, urgency and relevant arrangements matter.

Can I refuse every inspection or repair visit?

No blanket right to refuse all necessary access should be assumed. Article 319 covers necessary works and visits. If a proposed time is unsuitable, explain why and offer workable alternatives.

Can an estate agent bring buyers into my home?

Necessary sale visits fall within Article 319, but should be organised with appropriate notice and regard for the tenant’s interests. An agent’s involvement does not create unrestricted access.

Does agreeing to one visit authorise later visits?

Do not assume that permission for one appointment covers unrelated future visits. Examine what was agreed, including purpose, attendees, timing and any limits.

What if there is a genuine emergency?

A genuine emergency requires separate assessment of danger, necessity and proportionality. It is not a general excuse for routine entry. Contact 112 for an immediate emergency.

Can unauthorised entry be a criminal offence?

Article 116 addresses entry against consent and failure to leave after entry with consent. The facts, intent, consent and any lawful basis must be examined before determining criminal liability.

Can the landlord change the locks because I owe rent?

Unpaid rent should be addressed through the applicable legal procedures rather than assumed to authorise a unilateral lockout. Record what occurred and obtain prompt advice about the appropriate remedy.

What evidence should I keep after an unexpected entry?

Preserve the lease, access requests, consent or objection messages, dates, attendees, lawfully available access records, original photographs and relevant incident reports.

Does a tenancy mediation application replace a criminal complaint?

No. Civil tenancy procedures and reporting alleged criminal conduct are separate matters. Review the appropriate route, complaint requirements and time limits for the incident.
