Leaving a Rental Property Early in Turkey: Notice, Replacement Tenants and Remaining Rent

Landlord & Tenant Law · Early Departure · Antalya

Planning to Leave Your Rental Home Before the Lease Ends?

Leaving a rental property early in Turkey involves three different questions: how the tenancy can end, when possession is returned and what rent may remain payable. A flight booking or an empty apartment does not answer all three.

When I examine an early departure, I start with the lease dates and the proposed handover. I then distinguish an agreed exit from a unilateral departure and look at any replacement tenant proposal. This helps identify the issue before discussing a final payment.

This guide focuses on ordinary residential rentals, including homes occupied by foreign residents in Antalya. It explains notice, replacement tenants, remaining rent and the documents that help prevent a disputed exit.

Guide date: Practice area: Landlord & Tenant Law Primary legislation: Turkish Code of Obligations No. 6098
Quick Answer

Moving out early does not automatically end your rent liability. Article 325 links continuing obligations after early return to a reasonable period for reletting on similar terms. A qualifying replacement tenant may bring those obligations to an earlier end. Check the exit terms, notice, return of possession and evidence before treating the final account as settled.

Key Distinction Notice is not handover Saying you intend to leave, delivering the keys and agreeing that no further rent is due are separate events.
Priority 1 Check the lease term and any early exit provision.
Priority 2 Use a legally appropriate notice and preserve delivery evidence.
Priority 3 Document a replacement tenant’s readiness and proposed terms.
Priority 4 Record key handover and the final financial agreement.

Are You Ending the Tenancy or Returning the Property Early?

Before drafting a notice, identify what you intend to do. The practical options should not be treated as interchangeable.

Ordinary Termination Leave on the proper termination date

Check the term, notice requirements and effective end date.

Agreed Departure Negotiate a documented early exit

Clarify handover, payments and which future claims are resolved.

Early Return Return before the proper date

Consider Article 325 and the resulting financial position.

Another Legal Ground Examine a distinct termination basis

Serious defects or important reasons require their own analysis.

Read the signed lease and amendments, rather than relying on an agent’s summary. For the broader framework, see Renting Property in Turkey as a Foreigner and our landlord and tenant law services in Antalya.

Check the accommodation type Ordinary homes, temporary-use accommodation and commercial premises may raise different issues. In particular, Article 339 contains an exception for inherently temporary-use properties let for six months or less.

Does Giving 15 Days’ Notice Let You Leave at Any Time?

No. The 15-day rule is tied to the end of the fixed term. Under Article 347, a qualifying fixed-term residential or roofed commercial lease generally extends for one year unless the tenant gives notice at least fifteen days before the term ends. It is not a general right to leave mid-term without further liability.

Indefinite-Term Leases

Articles 328–329 govern termination periods and notice under the general framework. In the absence of a relevant local custom, Article 329 uses six-month termination periods with three months’ notice. Check the actual lease and applicable rules before calculating a date.

A one-year residential lease that has renewed is not automatically an indefinite-term lease. Start with its legal structure, rather than the number of years you have occupied the apartment.

How Should You Give Notice to Your Landlord?

Article 348 requires written termination notice for residential and roofed commercial leases. Its wording, timing and delivery should be checked together.

I would not treat a message saying “I may move next month” as a complete departure plan. It may record a conversation without clearly identifying the intended legal step or final date.

  • Identify the tenant, landlord and property.
  • State the intended termination or departure date clearly.
  • Distinguish a termination notice from a request for an agreed exit.
  • Check the appropriate recipient and delivery address.
  • Preserve the signed document and proof of delivery.

Email and WhatsApp exchanges can help establish communications, but should not automatically be treated as satisfying every requirement for a legally effective notice. A notarial notice may help document content and delivery, depending on the circumstances.

A family home requires an additional check Article 349 addresses the spouse’s express consent when the rented property is used as the family home. Check this before assuming the named tenant can terminate alone.

Must You Pay Every Remaining Month of Rent After Leaving Early?

Early Return of the Property Turkish Code of Obligations · Article 325

After return without observing the contractual term or termination period, lease obligations continue for a reasonable period in which the property could be relet on similar terms.

Source: Law No. 6098, Article 325 .

The remaining months shown in the contract are therefore not, by themselves, a complete calculation of the amount recoverable. Equally, physical departure is not proof that no further payment is due.

Keep any demand for “all remaining rent” and ask for its basis. The lease provisions, return date, reletting evidence and relevant deductions need to be considered before accepting that total.

Is the Reasonable Period Always One, Two or Three Months?

Article 325 does not prescribe a fixed number of months. A practical investigation should examine the property’s condition, location, original terms and opportunities for comparable reletting.

For an Antalya apartment, I would look for evidence rather than assume that the same period applies to every district or season. Advertisements, viewing records and actual offers can help explain what happened after return.

  • What were the original rent and other material terms?
  • Was the apartment ready to be shown and occupied?
  • When was it advertised, and on what terms?
  • Were viewings or concrete applications received?
  • When did a new tenancy or another use begin?

The actual vacancy period and a reasonable reletting period are different questions. Investigate the reasons for any delay instead of treating the eventual letting date as the only relevant fact.

Can Finding a New Tenant End Your Continuing Obligations?

Article 325 provides an earlier end to lease obligations where, before the reasonable period expires, the tenant finds a replacement whom the landlord can reasonably be expected to accept, who has payment capacity and is ready to take over the tenancy.

Acceptability A concrete, suitable candidate

Explain who the person is and the proposed use of the home.

Payment Capacity Relevant financial information

Provide appropriate supporting information with the candidate’s consent.

Readiness A genuine commitment and start date

A vague expression of interest is different from a concrete proposal.

Proposed Terms Make the comparison possible

Record rent, commencement and other material terms without concealing differences.

A replacement proposal is not permission to transfer possession yourself Article 323 separately regulates transfer of the tenancy and requires the landlord’s written consent. Do not hand the apartment to another person on the assumption that naming them settles the matter.

What Should You Record When Proposing a Replacement Tenant?

Give the landlord enough information to respond to a real proposal. Retain the version sent, the delivery date and the response.

  • The candidate’s identity and contact details.
  • Their intended start date and proposed occupancy.
  • The rent and other terms they are prepared to accept.
  • Relevant evidence of payment capacity, shared with permission.
  • Their written confirmation of readiness to proceed.
  • Any appointment, viewing, response or reason for rejection.

I would distinguish “my friend is interested” from a dated proposal that can actually be examined. The better record explains what was offered, when it was available and what the landlord was told.

Share only information reasonably needed for the proposal. Avoid circulating unnecessary personal or financial documents.

What If the Landlord Rejects the Candidate or Demands a Higher Rent?

Record the response and any stated reason. Rejection alone does not establish that your candidate qualified, or that every continuing claim is justified. Compare the actual proposal with the statutory conditions.

If the landlord advertises at a substantially different rent, preserve the dated listing and correspondence. As a practical evidential point, this may help explain why the property remained vacant and whether the terms being sought were comparable.

Deductions From the Claim Article 325 · Second Paragraph

The landlord must deduct saved expenses and benefits obtained, or intentionally avoided, through another use of the property.

Source: Turkish Code of Obligations, Article 325 .

Ask for a dated account of new occupation or use rather than assuming that the apartment stayed empty. This helps test the requested period and avoid an unexplained overlap in the accounting.

Can You Agree an Early Exit With the Landlord?

A clearly documented agreement can reduce uncertainty about the departure date and final payments. Check its wording before signing, particularly if it contains a general release or acknowledgment of debt.

Practical points to address in a departure agreement
Point What to Clarify
End date The agreed termination and possession-return dates.
Rent The final amount and whether later rent claims are resolved.
Deposit Any agreed deduction, repayment amount and payment date.
Bills and condition Which items are settled and which remain to be accounted for.
Authority and signatures Who is signing and whether they can bind the relevant party.

“You can bring the keys tomorrow” may confirm an appointment without confirming that every future claim is waived. I would make the financial agreement explicit instead of relying on that inference.

Why Does Key Handover Matter When You Leave Early?

Evidence of return is central to organising an early-departure file. An empty apartment, cancellation of a utility account or a departure flight does not necessarily establish when the landlord recovered possession.

1
Arrange the handover

Confirm the date, recipient and their authority in writing.

2
Record condition and final readings

Photograph the property, inventory and meters before access ends.

3
Document delivery

Record the address, date, keys, access devices and recipient.

4
Keep the financial position clear

Separate acknowledgment of handover from agreement about remaining payments.

If the landlord refuses delivery, obtain advice about a legally appropriate way to complete and prove return. Avoid leaving keys with an unauthorised person or merely posting them through a door.

Does Leaving Early Mean You Lose Your Deposit?

Early departure does not, by itself, settle the deposit account. Compare the security payment with any supportable rent, expense or damage claim. Do not assume either automatic forfeiture or automatic repayment of the full amount.

Keep remaining-rent calculations separate from painting, cleaning and damage deductions. Our dedicated guide, Getting Your Rental Deposit Back in Antalya: Deductions, Damage and Evidence, explains the property-condition and refund issues in detail.

Do not simply stop paying on the assumption that the deposit covers the final rent. Check any agreement or set-off and document how it affects the balance.

What If You Must Relocate, Leave Turkey or Move Because of Defects?

Record the reason and supporting documents, but do not assume that a relocation, work change or immigration decision automatically cancels every tenancy obligation.

Important Reasons

Article 331 addresses extraordinary termination for important reasons making continuation intolerable, subject to statutory notice. Its financial consequences are determined with regard to the circumstances.

Serious Property Problems

If you are leaving because of leaks, unsafe conditions or another serious defect, preserve reports, photographs and repair requests. The nature of the problem and the steps taken before departure require a separate legal examination.

Explain the legal route before calculating the bill An ordinary voluntary move, a negotiated departure and a claimed justified termination may produce different questions. A generic “early exit fee” does not resolve those differences.

An Early Departure Timeline: Which Dates Should You Compare?

Imagine a tenant who tells the landlord on 5 April that they plan to leave, returns the keys on 20 April and proposes a candidate ready to start on 1 May.

I would place those dates alongside the lease end date, the candidate’s written proposal, the landlord’s response and any actual reletting record. Each document answers a different question.

Communication 5 April

What was said, in what form, and was it a notice or a request?

Return 20 April

Who received possession and what evidence records the handover?

Candidate Proposed start: 1 May

What terms and supporting information were actually presented?

Final Account Check the claimed dates

Does the demand explain its period, calculation and relevant credits?

Illustration, not a reported case These dates show how to organise the evidence. They do not establish an automatic liability cut-off or a fixed amount of rent.

What If the Landlord Demands Rent After You Have Left?

Request a written calculation showing the period, amount and legal or contractual basis. Preserve the demand alongside the notice, handover and replacement proposal records.

Rental disputes generally require mediation before a lawsuit under Article 18/B of Law No. 6325, subject to the statutory exception for specified eviction proceedings through non-judgment enforcement. Identify the intended procedure before taking action.

A formal enforcement payment order or court document needs prompt attention because procedural response periods may apply. Do not treat it as an ordinary negotiation message.

If there is also a dispute about an undertaking to vacate, see tenant eviction and eviction undertakings in Antalya.

What Should Foreign Tenants Do Before Leaving Antalya?

Before leaving a home in Konyaaltı, Muratpaşa or another Antalya district, organise the exit documents while you can still inspect the apartment and arrange handover.

  • Keep the complete lease and any agreed exit provision.
  • Save notices and delivery records.
  • Preserve candidate proposals and landlord responses.
  • Back up photographs, inventory and handover documents.
  • Record rent, deposit, final bills and any agreed settlement.
  • Maintain reliable contact details after departure.

If the dispute must be managed from abroad, review the authority and document requirements described in Remote Legal Representation in Turkey.

Do not rely on a verbal “it is fine”. Clarify exactly which date and payments have been agreed.
Do not confuse departure with return of possession. Record delivery to the landlord or an authorised recipient.
Do not move a candidate in without the necessary arrangements. A proposal and an authorised transfer serve different purposes.
Do not sign an unexplained acknowledgment of debt. Check the calculation and scope before agreeing to it.

How I Review an Early Departure File

I start by separating the notice date, the return date and any claimed financial cut-off. I then compare each with the lease and supporting documents, rather than beginning with a presumed number of months’ rent.

1. Lease structure I identify the property type, term, renewal history and relevant clauses.
2. Departure route I distinguish ordinary termination, agreement, early return and any other claimed ground.
3. Notice and delivery I examine the wording, recipient, timing and delivery evidence.
4. Return of possession I check the keys, handover documents and any refusal to receive them.
5. Replacement proposal I compare the candidate’s terms, readiness and supporting information.
6. Reletting chronology I look at advertisements, responses, occupation and other available records.
7. Final account I separate rent, expenses, damage, security and payments already made.
8. Next procedural step I identify deadlines, mediation and representation requirements for the particular dispute.

Frequently Asked Questions

Leaving a Rental Property Early in Turkey

Can I leave a rental property before the lease ends?

An early departure should be planned around the lease, legal exit route and return of possession. Moving out does not automatically settle remaining rent or other obligations.

Does 15 days’ notice allow me to leave in the middle of a fixed term?

No. Article 347’s 15-day rule concerns notice before the fixed term ends. It is not a general mid-term exit right. Early return requires separate consideration.

Must I pay all the rent remaining under the contract?

The remaining contractual months alone do not establish the final amount. Article 325 addresses continuing obligations after early return, including the reasonable reletting period, a qualifying replacement and relevant deductions.

Is the reasonable reletting period always three months?

No fixed three-month period is prescribed by Article 325. The property, terms and relevant reletting evidence need to be examined.

What kind of replacement tenant should I propose?

Article 325 refers to a replacement whom the landlord can reasonably be expected to accept, who has payment capacity and is ready to take over the tenancy. Document the candidate and proposed terms.

Can I hand the apartment to a friend without the landlord’s consent?

Do not assume that proposing a replacement authorises a transfer of possession. Article 323 separately requires the landlord’s written consent to transfer the tenancy. The necessary arrangements should be checked first.

Does returning the keys mean no more rent is payable?

Key handover helps establish return of possession. It does not, by itself, show that the landlord has waived every further claim. Keep the handover and financial agreement separately documented.

What if the landlord refuses to accept the keys?

Preserve evidence of the attempted handover and seek advice about a legally appropriate way to complete and prove return. Avoid leaving keys with an unauthorised person or relying only on a message saying you have left.

Do I automatically lose my deposit if I leave early?

Early departure does not automatically settle the deposit account. Compare the security with any supportable rent, expense or damage claims and record the final calculation.

Does leaving Turkey cancel my tenancy obligations?

Departure from Turkey does not, by itself, establish termination or settlement. Check the exit route, notice, return of possession and any separate reason relied upon.

Is mediation normally required before a lawsuit about remaining rent?

Rental disputes generally fall within mandatory pre-litigation mediation under Article 18/B of Law No. 6325, subject to statutory exceptions. The intended procedure should be identified before filing.
