Arrested for DUI in Antalya: Step-by-Step Emergency Guide for Tourists

If you are a foreign tourist dealing with a suspected drunk-driving incident in Antalya, first establish whether you are facing only a roadside traffic procedure, an administrative sanction, formal custody, police questioning or a criminal investigation. These are not the same legal situation. If criminal proceedings are involved, your immediate priorities are understanding the accusation, obtaining legal and language assistance where necessary, protecting your procedural rights, keeping the official documents and confirming what must happen before you leave Turkey.

Ask what your current legal status is, what allegation is being investigated and whether a criminal statement will be taken. Do You Have the Right to a Lawyer During a DUI Investigation in Turkey?

Yes. If the incident has become a criminal investigation, Turkish criminal procedure recognises the right of a suspect or defendant to benefit from defence counsel.

Right to Defence Counsel CMK Article 149

A suspect or defendant may benefit from one or more defence lawyers at every stage of the investigation and prosecution. Counsel may meet the suspect, remain present during statement-taking or questioning and provide legal assistance.

This is particularly important where:

You are being questioned as a criminal suspect.
TCK Article 179/3 is mentioned.
The alcohol level is high.
An accident occurred.
Another person was injured.
You do not understand the documents being presented.
You are expected to leave Turkey shortly.

Can You Remain Silent During Police Questioning in Turkey?

A criminal suspect has the right not to make a statement concerning the accusation.

Statement and Questioning CMK Article 147

During statement-taking or questioning, the suspect must be informed of the accusation, the right to defence counsel and the legal right not to make a statement concerning the alleged offence.

Identity questions are different The right not to make a statement concerning the accusation should not be confused with identity verification. Under CMK 147, the suspect is required to answer questions concerning identity correctly.

A foreign tourist should avoid giving an improvised explanation merely because the situation is stressful or because the person believes that speaking quickly will make the process end sooner.

Can You Request an Interpreter During a Turkish DUI Investigation?

Yes, where the person does not know Turkish sufficiently to express or understand the relevant matters in criminal proceedings.

The interpretation rules also apply during the investigation stage to a suspect who cannot sufficiently use Turkish. At that stage, the interpreter is appointed within the criminal procedure by the competent judge or public prosecutor.

Is a friend the same as a legal interpreter?

No. A friend can sometimes assist with ordinary communication, but informal assistance is not the same as interpretation provided within a formal criminal procedure.

Do not pretend to understand legal Turkish If you understand conversational Turkish but cannot reliably understand criminal-law terminology, say so clearly before a statement or document-signing procedure continues.

What Should a Tourist Know About the Breathalyzer Procedure?

Alcohol measurement is part of the traffic-enforcement procedure and should be distinguished from giving a criminal statement.

If you receive an alcohol measurement, preserve:

The recorded promille result.
The date and time of measurement.
The official measurement document.
Any administrative traffic penalty.
Any driving-licence withdrawal document.

Under the current 2026 framework, refusing the legally required alcohol or drug measurement can result in a 150,000 TRY administrative fine and withdrawal of the driving licence for five years.

Disputing a result and refusing the test are different issues If you believe a measurement or procedure is inaccurate or unlawful, the relevant question is how the official evidence can be legally reviewed. Refusal itself carries a separate severe sanction.

Should You Sign Turkish Police Documents You Do Not Understand?

A foreign tourist should not treat a document as a harmless routine form merely because it is presented for signature.

If you do not understand the document sufficiently:

Establish whether it is an alcohol record, administrative penalty, statement record, vehicle document or another procedural document.

The later legal assessment depends heavily on the official record.

Can You Contact Your Consulate After Being Arrested or Detained in Turkey?

Consular communication may be relevant for a foreign national who has actually been arrested, committed to custody or otherwise detained.

Where the detained foreign national requests it, the competent authorities are to inform the relevant consular post without delay. The Convention also recognises communication and access between the detained national and consular officers.

What can a consulate do?

Consular assistance may help with communication, practical support and information concerning sources of legal representation.

Does the consulate act as your Turkish criminal lawyer?

No. Consular officials do not replace defence counsel practising under Turkish law. The criminal case itself must be handled within the Turkish judicial system.

How Do You Know Whether the DUI Incident Has Become a Criminal Investigation?

One of the most important tasks before leaving the police station or Antalya is determining whether the incident remains an administrative traffic matter or has entered the criminal justice system.

Indicators can include:

You are being questioned as a criminal suspect.
A prosecutor becomes involved.
TCK Article 179/3 is referenced.
You receive a criminal-procedure document or summons.
An accident involving injury or another alleged offence is being investigated.
The file is referred to judicial authorities rather than ending with the traffic sanction.

What If Your Flight Leaves Antalya Today or Tomorrow?

A booked flight does not override a Turkish police, prosecutor or court procedure.

At the same time, not every alcohol-related traffic incident requires a foreign tourist to remain in Turkey indefinitely.

Before travelling to the airport, establish:

Whether you are formally free to leave the police procedure.
Whether a criminal investigation has been opened.
Whether a statement or other procedural act remains outstanding.
Whether a prosecutor or court has issued an order affecting you.
Whether you have received a summons.
Whether your driving licence has been withdrawn.
Whether the rental vehicle issue has been resolved.
Whether later steps can legally be handled through counsel.
Do not confuse “I can physically board a plane” with “the legal case is finished” An existing Turkish investigation or prosecution does not disappear merely because the foreign national leaves the country.

Can a Tourist Leave Turkey After a DUI Arrest or Criminal Referral?

There is no single answer for every case.

A foreign driver’s ability to leave and the legal consequences of departure depend on the actual procedural status, including whether any judicial restriction has been imposed.

The correct sequence is:

Determine whether the matter is administrative only or criminal.

Can You Appoint a Turkish Lawyer After Leaving Turkey?

In appropriate cases, a foreign client can appoint a Turkish lawyer through a valid power of attorney.

Depending on where the client is located, a power of attorney may potentially be executed through a Turkish consulate or through an appropriate foreign notarial procedure followed by the authentication or apostille requirements applicable to the document.

A power of attorney does not eliminate every personal-attendance requirement Whether a lawyer can complete a particular procedural act without the client depends on the nature and stage of the Turkish criminal proceeding.

What Should a Foreign Tourist Avoid During a DUI Investigation?

Do not give false identity information. Identity questions are legally distinct from your right not to make a statement concerning the accusation.
