Getting Your Rental Deposit Back in Antalya: Deductions, Damage and Evidence
Moving Out in Antalya? Protect Your Deposit Before Returning the Keys
Getting your security deposit back in Antalya starts with a clear record of what you paid, how the property looked when you moved in and what happened at handover. If your landlord proposes deductions for painting, cleaning, furniture or unpaid bills, ask for the specific reason and amount of each charge.
For foreign tenants, the problem often becomes harder after leaving Turkey: access to the apartment ends, conversations become difficult to reconstruct and photographs may be the only remaining record of its condition. This guide explains rental deposit refunds, disputed deductions, normal wear, damage and evidence in ordinary residential tenancies.
A statement that “the apartment needs work” does not, by itself, establish a valid deposit deduction. Identify the alleged damage or debt, compare the supporting evidence and request an itemised calculation. Keep proof of your deposit payment, the property’s condition and key handover. The recovery route also depends on whether a bank or the landlord holds the money.
What Rules Apply to a Rental Deposit in Antalya?
For residential and roofed commercial leases within this statutory regime, agreed security cannot exceed three months’ rent.
Source: Law No. 6098, Article 342 — official statutory text .First identify the payment. A deposit, advance rent, an estate agent’s commission and a reservation payment serve different purposes. Check the lease, transfer description and correspondence before treating every initial payment as refundable security.

Is Your Deposit Held by a Bank or Directly by the Landlord?
Article 342 provides for monetary security to be placed in a term savings account subject to withdrawal restrictions. Release requires both parties’ consent, finalised enforcement proceedings or a final court decision.
Obtain the account documents and ask the bank which records it requires to release the money.
Preserve the bank transfer or receipt, the recipient’s acknowledgment and the lease provision describing the deposit.
The bank-release procedure cannot simply be applied to money already paid into the landlord’s ordinary account. In that situation, identify the repayment obligation, any disputed deductions and the appropriate claim against the responsible party.
When Should Your Rental Deposit Be Returned?
There is no single refund date that can be applied to every deposit arrangement. Begin with where the money is held, whether the tenancy has legally ended, the repayment terms and any outstanding obligations.
If the landlord does not notify the bank in writing of qualifying lease-related court, enforcement or bankruptcy proceedings within three months after the lease ends, the bank must release the security at the tenant’s request.
Source: Turkish Code of Obligations, Article 342 .This provision does not require every tenant to wait three months before seeking repayment. Bank-held security may be released earlier through another statutory release basis, including both parties’ consent.
For a directly paid deposit, send a written repayment request once handover and the final account can be addressed. If the landlord says a bill is pending, ask which bill, which period it covers and when the remaining balance will be accounted for.
Can Your Landlord Keep the Entire Rental Deposit?
The entire deposit is not automatically forfeited because the landlord alleges damage. Compare the amount withheld with the legally supportable obligations and losses. Full retention needs justification just as a partial deduction does.
Organise each proposed deduction separately. Unpaid rent, a broken appliance and a cleaning charge raise different questions and should not be combined into a single unexplained total.
- What exact damage or unpaid obligation is claimed?
- Was the alleged defect present when you moved in?
- What connects the problem with your use of the property?
- When was it inspected and reported?
- How was the amount calculated?
- Does the estimate include improvements or unrelated work?
Ask for relevant photographs, inspection records, estimates, invoices or other supporting material. These documents have different evidential roles: an invoice may show an expense, but it does not alone establish that the tenant caused the problem.
If only part of the deposit is disputed, request repayment of the undisputed balance. Make clear whether a payment is partial repayment or a final settlement.
What Is the Difference Between Normal Wear and Tenant Damage?
The tenant must return the property in the condition received, but is not responsible for ageing and deterioration resulting from use consistent with the contract.
Source: Law No. 6098, Article 334 .Normal wear describes changes associated with ordinary, contract-compliant use. Tenant damage concerns a different question: whether the tenant is responsible for a particular loss. The original condition, length of occupation and cause of the change are central to that comparison.
| Claimed Problem | What to Investigate | Useful Evidence |
|---|---|---|
| Faded paint | Age, sunlight and ordinary occupation. | Move-in photographs, tenancy length and decoration history. |
| Burn marks or deep gouges | Possible damage beyond ordinary use. | Comparable images and a focused repair assessment. |
| Mould or damp | Leaks, building defects, ventilation or combined causes. | Earlier complaints, maintenance records and technical findings. |
| Broken appliance | Age-related failure, an existing fault or misuse. | Inventory, service history and a technician’s findings. |
| Missing furniture | Whether the item was supplied and later returned. | Signed inventory and handover photographs. |
A Practical Example: An Old Stain and a New Tear
Imagine that a furnished apartment’s sofa already had a stain at move-in, recorded in dated photographs. At move-out, the landlord cites that stain as a reason to replace the sofa. The earlier images help challenge the allegation that the tenant caused it.
If a new tear also appears, it requires a separate explanation. Evidence of an old stain does not resolve responsibility for a new tear. Equally, a new tear does not automatically establish entitlement to the full cost of a brand-new sofa.
Can Painting or Cleaning Costs Be Deducted From Your Deposit?
Painting and cleaning charges require an explanation of the work, its cause and its cost. A tenancy ending does not, by itself, show that the tenant must finance redecoration.
Painting Charges
Distinguish faded decoration from staining, unauthorised alterations or other alleged damage. If one area is affected, ask why the quotation covers several rooms. A renovation estimate may include work unrelated to the tenant’s responsibility.
Cleaning Charges
Photograph the kitchen, bathrooms, cupboards, floors and appliances after cleaning. Keep any cleaning receipt alongside those images: the receipt records a service, while the images help show the final condition.
Article 334 also invalidates advance agreements imposing additional end-of-lease compensation beyond remedying damage from use contrary to the contract. A clause labelled a “standard move-out charge” therefore needs to be checked against the statutory rules.
Source: Turkish Code of Obligations, Article 334 .What About Furniture and Appliance Damage in a Furnished Apartment?
Start with the inventory. Identify the item, its condition and any known faults. Model details and photographs help avoid confusion between the appliance originally supplied and a proposed replacement.
Photograph upholstery, doors, drawers and appliances. Note missing parts and keep messages reporting malfunction.
Take comparable images, count supplied items and retain maintenance or service records.
When a replacement is claimed, ask whether repair is possible, how old the item is and why replacement is said to be necessary. These are practical questions for investigating the amount claimed, rather than a fixed depreciation formula.
An appliance failing during occupation is not enough, on its own, to identify the cause. A technician’s findings may help distinguish ordinary failure from misuse.
Does the Landlord Need to Notify You of Damage in Writing?
Article 335 requires inspection at return and immediate written notification of defects for which the tenant is responsible. Failure to notify affects liability. Defects not discoverable by ordinary inspection are treated separately and must be notified immediately once discovered.
Source: Law No. 6098, Article 335 .Preserve the inspection date, handover record and first written complaint. If a damage claim arrives later, identify whether it concerns something visible at handover or an alleged hidden defect.
What Evidence Helps You Get Your Rental Deposit Back?
The most useful file shows what was paid, what was received, what changed and when possession ended. Keep the documents in chronological order so that each disputed deduction can be checked.
- The complete lease, amendments and inventory.
- Deposit transfers, receipts and payment acknowledgments.
- Original move-in and move-out photographs and videos.
- Messages reporting existing defects or requesting repairs.
- Rent payments, final bills and meter readings.
- Key handover and inspection records.
- The deduction list and supporting estimates or invoices.
- Refund requests, responses and partial repayment records.
Preserve Originals and Conversation Context
Back up original media, rather than relying only on compressed messaging-app copies. Keep relevant conversations with dates and participants. Screenshots can help organise the file, but authenticity and context may still be disputed.
Make Photographs Comparable
Take wide room views and close-ups. A close-up may show a mark without establishing its location or whether it existed before the tenancy. Use the same angles as the move-in photographs where possible. Collect evidence lawfully and avoid unnecessary recording of other people’s private activity.
What Should You Do Before Returning the Keys?
Invite the landlord or authorised representative and keep the arrangement in writing.
Photograph the empty property, remaining furnishings and final readings before handover.
Identify the property, date, recipient, keys and access devices in the handover record.
Do not sign a statement accepting damage or confirming full repayment unless it reflects what happened.
If the landlord refuses to attend or accept the keys, obtain advice about documenting and completing delivery. Leaving keys with a neighbour or estate agent without confirmed authority can create a further dispute.
If departure follows an eviction notice or undertaking, see our guide to tenant eviction and eviction undertakings in Antalya. Address both the return of possession and the final deposit account.
How Should You Request Your Deposit Refund?
Send a factual written request identifying the property, lease, deposit payment and handover date. State the amount sought, provide repayment details and request an itemised explanation of any withheld balance.
- Identify the amount and currency originally paid.
- Refer to the payment evidence and key handover record.
- Ask for repayment and supporting documents for deductions.
- Propose a clear date for a response.
- Keep evidence of the request and the reply.
Your proposed response date is a practical follow-up date, not a universal statutory deadline. Where default, interest or formal notification is relevant, the wording and delivery method need case-specific consideration.
If the deposit was paid in foreign currency, preserve the original amount and currency. Do not assume that repayment automatically uses today’s rent or a particular exchange rate. Check the agreement and the applicable monetary rules.
Can You Use the Deposit as Your Last Month’s Rent?
Do not assume the deposit automatically pays your final rent. Security and rent are different obligations. Any proposed agreement or set-off should be checked and clearly documented.
Final Utility Bills and Building Charges
Keep final meter readings, settlement receipts and account-closure documents. Ask which period a charge covers and whether it is actually your obligation. If a bill is pending, agree how the final calculation will be completed and recorded.
Leaving Before the Proper Termination Date
Article 325 addresses obligations when premises are returned without observing the contractual term or termination period, including the reasonable reletting period and conditions concerning a replacement tenant. The final account may therefore involve more than physical damage.
Source: Turkish Code of Obligations, Article 325 .Keep rent-increase disputes separate from the refund calculation. For that issue, see rent increases and tenant rights in Turkey.
What If the Property Was Sold or an Estate Agent Collected the Deposit?
If ownership changed, assemble the original lease, payment record, sale-related notices and correspondence about the deposit. Identify who held the money and whether its treatment was addressed during the transfer.
For the wider effect of a sale on the tenancy, read My Landlord Is Selling the Property: Do I Have to Move Out?
If an estate agent received the money, confirm whether it was a deposit, commission or another payment, and in whose capacity it was collected. The person who arranged the tenancy is not necessarily the correct party for every repayment claim.
Is Mediation Required Before a Rental Deposit Lawsuit?
An ordinary rental deposit refund lawsuit generally falls within mandatory mediation for disputes arising from rental relationships. The statutory exception concerns specified eviction proceedings through non-judgment enforcement.
Source: Union of Turkish Bar Associations — Article 18/B and the provisions effective from 1 September 2023 .A repayment request, enforcement application and lawsuit are different procedural steps. The appropriate route needs to be identified before filing. Bank release under Article 342 is also a separate mechanism.
Record the amount, currency, payment date and agreed deductions. Specify whether the agreement resolves only the deposit or other tenancy claims as well.
Consider the disputed amount, documents, likely evidential issues and procedural costs before choosing the next step.
Can You Recover Your Deposit After Leaving Antalya?
Leaving Turkey does not, by itself, erase a deposit claim. Representation may be possible depending on the intended procedure and authority required. Preserve your documents before access to the apartment ends.
Whether your rental home is in Konyaaltı, Muratpaşa or another Antalya district, keep the landlord’s identifying and contact information, payment records and handover evidence together. Maintain a reliable channel for communications after departure.

How Is a Rental Deposit Dispute Reviewed?
A structured review follows the payment and handover chronology. Each deduction is then compared with the lease, condition records and relevant statutory requirements.
Rental Deposit Refunds in Antalya
What should I do if my landlord refuses to return my deposit?
Gather the lease, payment evidence, condition records and proof of handover. Request repayment and an itemised explanation of deductions in writing. The next step depends on where the deposit is held and the nature of the dispute.
Can my landlord keep my entire rental deposit?
The entire deposit is not automatically forfeited because damage is alleged. Compare the amount retained with the legally supportable obligations and losses. Request a breakdown and supporting evidence for each claimed deduction.
When should my rental deposit be returned?
The answer depends on where the money is held, termination, repayment terms and outstanding obligations. Article 342’s three-month bank-release provision is not a universal refund timetable for deposits paid directly to landlords.
Can my landlord keep the deposit for ordinary wear and tear?
Article 334 distinguishes deterioration from contract-compliant use from damage for which the tenant is responsible. The original condition, tenancy length and cause of the change should be examined.
Is repainting always deductible from the deposit?
No automatic conclusion follows from a repainting quotation. Identify why the work is needed, compare the original condition and check whether the quotation includes unrelated decoration or improvements.
Does the landlord always have three months to refund the money?
No. Article 342’s three-month provision concerns release of bank-held security where the landlord has not notified qualifying proceedings. It is not a general waiting period for every deposit, and other statutory bank-release bases may permit earlier release.
What if I paid the deposit in cash?
Preserve any receipt, lease acknowledgment or message confirming receipt of the money. Absence of a bank transfer alone does not resolve whether payment can be established; the available evidence must be examined.
Are photographs and WhatsApp messages useful evidence?
They can help document condition, payment acknowledgments and communications. Keep originals, dates and conversation context. Authenticity, relevance and procedural admissibility may still need assessment.
Can I stop paying the final month’s rent because there is a deposit?
Do not assume that the deposit automatically replaces rent. Check any proposed agreement or set-off and document it clearly before treating the final rent as paid.
Can I pursue a refund while living outside Turkey?
Representation may be possible depending on the procedure and authority required. Preserve your documents before departure and check power-of-attorney and other formalities for the intended legal steps.
Is mediation normally required before a deposit refund lawsuit?
An ordinary rental deposit refund lawsuit generally falls within mandatory mediation for rental disputes under Article 18/B of Law No. 6325. The intended procedure and applicable exceptions should still be checked.
