Holiday Rental Fraud in Antalya: What Evidence Should You Preserve?
A villa listing disappears after payment, a genuine business denies issuing your confirmation, or the advertised address leads to accommodation that was never available to you. If you suspect holiday rental fraud in Antalya, preserve the booking trail before advertisements, accounts and conversations change.
Capture the listing
Keep the full URL, listing reference, photographs, advertiser details and terms.
Preserve the promises
Retain what was represented before payment and what happened afterwards.
Trace the payment
Record the recipient, amount, currency, transaction reference and payment instructions.
Document the discovery
Explain how you learned that the booking or advertiser might not be genuine.
1. Is the failed holiday booking evidence of fraud?
A missing refund, cancellation or disagreement over accommodation quality does not, by itself, establish fraud. Examine what was represented, whether it was false, how it influenced the booking and what payment or other benefit followed.
Articles 157 and 158 of the Turkish Criminal Code regulate fraud and its aggravated forms. Classification depends on the conduct and evidence, including how digital systems were used. An online message or bank transfer does not alone settle that question.
Facts potentially supporting fraud
A fabricated confirmation, impersonation of a genuine business, false authority to let a property or an invented accommodation offer may be relevant when supported by evidence.
Facts requiring a different assessment
A genuine booking affected by cancellation, service defects, a disputed deduction or contractual interpretation may involve consumer or civil remedies.
The Ministry of Justice’s fraud guidance emphasises documenting deceptive conduct. Describe what the evidence shows rather than relying only on the label “scam”.
2. Preserve the advertisement before it changes or disappears
Capture the full listing while it remains accessible. Preserve enough information to identify the advertisement and the account that published it, not only the property photographs.
- Full address: save the complete page URL and any payment-page URL.
- Listing reference: record the advertisement or property identification number.
- Advertiser account: save the profile URL, username and visible account identifier.
- Offer: preserve dates, price, accommodation details and booking conditions.
- Business claims: record the name, contact details and claimed registration information.
- Capture details: note when you accessed and saved the material, including the time zone where relevant.
Keep screenshots showing the surrounding page and identifying information. Save a PDF or other available page copy too. Preserve linked documents and earlier versions already stored on your device.
What if the listing has already been deleted?
Collect the traces still available: browser history, shared links, booking emails, notifications, screenshots and messages containing the listing reference. Note when you first discovered that the page was unavailable.
Create a record of the removed listing
Keep the original URL, listing or profile identifier, last known accessible date, date removal was noticed and the platform support reference together. Preserve the platform’s replies and explain which records you asked it to retain.
Where practicable, save accessible evidence before reporting the listing, then report promptly. A platform may remove or restrict access after a complaint. Further account or activity records may require an official request.
3. Show what you were told before making payment
Preserve the offer, questions, answers, payment request and confirmation as one chronological record. A conversation beginning only after the loss may omit the representation that influenced your decision.
| Issue | Evidence to preserve | Question it may help answer |
|---|---|---|
| Availability | Advertised dates, availability messages and booking confirmation. | Was the accommodation represented as available for your stay? |
| Identity and authority | Business claims, profile details and statements about ownership or agency. | Who claimed to be entitled to arrange the booking? |
| Property | Address, photographs, location links and arrival instructions. | What property was offered and how was it described? |
| Payment | Deposit request, recipient details, receipt and transaction reference. | Why, when and to whom did you pay? |
| Discovery | Platform replies, property contact responses and failed arrival records. | What supports the concern that the offer was deceptive? |
| Loss | Paid amounts, refunds and replacement-accommodation receipts. | What financial consequences are documented? |

Keep originals as well as readable copies
Retain complete message exports, original emails, attachments and photographs where available. Screenshots can explain the chronology, but cropped images may omit sender details or context.
Use copies for highlighting and translation. Keep original-language material unchanged and identify who supplied any translation.
4. Preserve the payment trail and contact the provider promptly
Keep both the instruction to pay and proof that payment occurred. A transfer receipt may identify an account but does not explain what the advertiser promised in exchange.
- Record the amount, currency, date and transaction reference.
- Preserve the recipient’s name, account details and payment description.
- Explain any move from a booking platform to private messages or another payment route.
- Keep later demands for another deposit, release fee or alleged refund charge.
- Retain bank, card-provider and platform case references.
Contact the bank or payment provider through independently verified channels. Ask which fraud-reporting, recall or dispute options apply to the transaction and which documents are required. Availability and recovery are not guaranteed.
A recipient account is an investigative lead
Identify the account accurately without assuming that its named holder created the listing or conducted every conversation. Account control and each person’s involvement require investigation.
Preserve additional payment demands before responding. Verify any claimed recovery service independently before sending money or sensitive documents.
5. Check bank, platform and legal time limits separately
Do not assume that reporting the incident through one route preserves every other option. A bank payment dispute, platform refund request and criminal complaint follow different procedures.
Bank and platform procedures
Ask which time limit applies to your payment method or booking, what event starts it and how a request must be submitted. Keep the provider’s written instructions.
Legal proceedings
Have the alleged conduct and any civil or consumer claim assessed under the relevant rules. A deadline applicable to another type of complaint should not be imported into the case.
Record the booking date, each payment, the intended arrival date, cancellation, discovery of suspected deception and subsequent notifications. These dates may serve different purposes.
Obtain an early assessment rather than waiting for every requested record. Explain what is available now and which evidence remains with the platform, bank or another party.
6. Distinguish the advertiser from the genuine property or business
An advertisement may copy photographs, names or registration details from a genuine business. Compare the exact domain, profile, telephone number and payment recipient rather than relying on a logo.
If a travel agency is claimed, independently check the relevant membership and contact information. TÜRSAB warns about imitation agency accounts and false verification details. A copied badge or number does not authenticate the person contacting you.
A genuine property owner or agency may itself be impersonated. Preserve its response and explain how you obtained the independent contact details.
Does a rental permit issue prove fraud?
No. Rental authorisation and alleged deception are separate questions. A claimed permit should be checked, but neither its presence nor absence alone determines criminal liability.
Where a residential tenant claims authority to offer short stays, the separate rules are discussed in subletting and short-term rental restrictions in Antalya.
7. Prepare a factual criminal complaint with an evidence index
Article 158 of the Turkish Criminal Procedure Code provides for reports and complaints to the public prosecutor’s office or law-enforcement authorities. Identify the actual location and transaction details so the competent authority can be assessed.
Present the booking history in order and connect each important point to a numbered attachment.
- The offer: where you found the listing and which accommodation and dates were advertised.
- The representation: what was claimed about availability, identity or authority.
- Your payment: amount, recipient, method and supporting records.
- The discovery: what happened and which facts indicate possible deception.
- Identifying leads: domains, account identifiers, telephone numbers and payment references.
- Requested evidence: relevant platform or financial records not in your possession.
- Documented loss: distinguish booking payments, refunds and additional expenses.
State uncertainties clearly. You can describe an unknown advertiser using the information available without inventing a name or presenting an inference as an established fact.

8. Can you complain after returning to your home country?
Leaving Turkey does not, by itself, prevent an incident from being reported. A lawyer may assist with the complaint and follow the file, subject to the necessary authority and procedural requirements.
Establish whether anything was reported during your stay and retain the reference. New evidence may belong in that file. Your personal account may still be required through an appropriate procedure.
Prepare the records before arranging overseas documents
Start with the listing, complete correspondence, payment records and chronology. Clarify the required authority before executing a power of attorney.
The broader reporting and follow-up process is explained in reporting a crime in Antalya after leaving Turkey. This article focuses on evidence specific to a holiday rental booking.
9. Does a criminal complaint guarantee a refund?
No. A criminal complaint concerns alleged criminal conduct. It does not automatically reverse a payment or award every claimed expense.
Bank disputes, platform procedures and potential civil or consumer remedies require their own assessment. Record any refund or reimbursement accurately and keep the information supplied to each organisation consistent.
If replacement accommodation or transport became necessary, retain receipts and explain the circumstances. Evidence that an expense was incurred does not, by itself, establish that it is recoverable.
Before accepting a settlement, check whether it includes a release of claims or withdrawal wording. Its effect should be assessed from the document and the legal classification of the matter.
10. Keep a clear record after the complaint is filed
Preserve the complaint, attachment list, submission evidence and official reference. Add later developments to the same chronology.
- Keep bank and platform case numbers separate from the Turkish investigation number.
- Label supplementary evidence and explain its connection to the existing report.
- Record later payments, refunds and communications from the advertiser.
- Keep your contact details current through the appropriate procedure.
- Review official requests and decisions promptly with their notification records.
If an account reappears under another name, preserve its URL, identifier and capture date, then explain the apparent connection. Do not access private accounts without authority or publish personal accusations as a substitute for reporting evidence.
Example: a villa advert disappears after a deposit
A family books a villa advertised as being near Antalya and pays a deposit after receiving a confirmation by message. The listing later disappears. A business contacted through an independently verified number says it did not issue the confirmation.
The useful evidence is the complete sequence: listing identifier and URL, claimed business identity, payment instructions, transfer record, confirmation and independent response. The platform support reference is added to the chronology.
The bank-account name is recorded as an identifying lead. Who controlled the advertisement and communications remains a matter for investigation. This account is more informative than stating only that “the holiday was cancelled”.
This is a hypothetical illustration, not a client account or a prediction of a criminal or financial outcome.
Frequently asked questions
What should I preserve after suspected holiday rental fraud in Antalya?
Keep the complete listing, URL, listing and advertiser identifiers, booking correspondence, payment instructions and transaction records. Document how you discovered the possible deception.
Does a cancelled booking automatically amount to fraud?
No. Cancellation, poor service or a disputed refund does not alone establish fraud. The alleged deception, benefit obtained and resulting loss must be assessed from the evidence.
What if the listing has already been deleted?
Retain screenshots, URLs, listing or profile identifiers, browser history, emails and messages. Record when removal was noticed and keep the platform support reference and replies.
Does the payment recipient’s name prove who created the scam?
No. It is an identifying lead. Control of the account, advertisement and communications, and each person’s involvement, require investigation.
Should I contact my bank before filing a criminal complaint?
Contact the bank or payment provider promptly about the options applicable to your transaction. Keep its reference and response. That process should not be assumed to replace a Turkish criminal complaint.
Does a platform report preserve all my legal deadlines?
Do not assume so. Bank, platform and legal procedures have different requirements. Check the relevant time limit and submission method for each route.
Can I report the incident after leaving Turkey?
Departure alone does not prevent reporting. Confirm the appropriate procedure, any existing file and the authority required for representation. Your personal account may still be needed.
Does a genuine agency logo or registration number authenticate the advertiser?
Not by itself. Genuine details can be copied. Independently verify the business and compare its actual contact details with the domain, account and payment instructions used.
Will filing a criminal complaint recover my deposit?
Recovery is not guaranteed. Criminal reporting, bank or platform disputes and potential civil or consumer remedies need separate assessment.
