Rental Guarantors: The Scope and Duration of Liability in Turkey

Signing as a rental guarantor can create personal financial exposure. However, a signature does not answer every question about validity, covered debts, the maximum amount or later rental periods. The guarantee must be read separately from the tenant’s obligations.

Validity

Check the written document, handwritten particulars and any required spouse consent.

Amount

Identify the maximum liability and compare it with the itemised demand.

Scope

Determine which obligations and rental periods the guarantee actually covers.

Duration

Separate the lease term, any agreed extension and statutory termination rules.

1. Are you a guarantor, a tenant or a witness?

Start with the capacity in which the person signed. A guarantor (kefil) provides personal security for another person’s obligation. A co-tenant may owe obligations directly. A witness signature serves a different purpose.

Check the signature block, clauses, annexes and actual arrangement. Descriptions such as “joint debtor,” “guarantor” or “responsible person” require legal interpretation rather than reliance on a heading alone.

A different label may not remove guarantor protections

Article 603 extends specified protections concerning form, capacity and spouse consent to other personal security arrangements given by natural persons under another name. Classification depends on the substance of the undertaking.

For the wider tenancy framework, see renting property in Turkey.

2. A signature alone may not satisfy the validity requirements

Article 583 requires written form and specified particulars. The guarantor must write the maximum amount and guarantee date in their own handwriting. If joint and several suretyship is undertaken, that status or equivalent wording must also be handwritten.

Printed wording followed by a signature should not be assumed sufficient. Conversely, an apparent omission should be checked against the complete original and every relevant annex before a conclusion is reached.

  • Obtain a clear copy of every page and the original where available.
  • Locate the handwritten maximum amount and date.
  • Check any handwritten joint and several undertaking.
  • Identify additions, corrections, separate declarations and signatures.
  • Check the execution date and any applicable transitional rules.

A notarisation should not be treated as a substitute for examining the statutory requirements. Signing under a power of attorney also requires review of the special authority and applicable form.

4. Which debts does the guarantee cover?

Review the defined principal obligation, covered period and maximum amount together. Article 589 governs the extent of surety liability, including specified ancillary items within the statutory framework and maximum limit. Not every charge added to a landlord’s demand is necessarily covered.

Rent and rental periods

Match each claimed month with the guarantee wording and the applicable tenancy records.

Other claimed sums

Examine expenses, damage, interest and legal costs individually rather than accepting a combined figure.

Certain penalties and damages arising from invalidity of the principal relationship are treated differently by Article 589. A broad phrase such as “all obligations” does not replace statutory analysis.

For an alleged furniture loss, first examine the underlying tenant liability. See furnished rental disputes, inventories and damage claims in Antalya.

Keep deposit records in the calculation. Security and payments may affect the outstanding claim, but neither automatically decides the guarantee’s validity. See rental deposit refunds in Antalya.

5. Ordinary and joint and several guarantees are different

Articles 585 and 586 distinguish ordinary suretyship from joint and several suretyship. They affect the circumstances in which the creditor may pursue the guarantor and the relevance of pursuing the debtor or other security first.

Do not assume that the landlord must always exhaust every step against the tenant. Equally, joint and several status does not remove the guarantee’s validity requirements, limits or available defences.

Preserve demands sent to both the tenant and guarantor, any default notices, security records and enforcement papers.

6. Does the guarantee continue when the lease renews?

The lease and guarantee have separate scope questions. Official rental decisions require assessment of whether extended periods were covered and whether the guarantor’s exposure was sufficiently defined by time and amount. Open-ended wording cannot simply be treated as unlimited liability.

Identify the initial lease term, the guarantee period, any renewal clause and subsequent declarations. A clause referring to renewal is not enough to avoid examination of the statutory form and limits.

What about rent increases or later amendments?

The tenant’s obligation to pay increased rent does not automatically establish the guarantor’s exposure to it. Compare the increase with the valid undertaking and maximum amount. Article 583 requires the prescribed form for later changes increasing the guarantor’s responsibility.

  • Was the renewal period actually included?
  • Was the guarantor’s maximum amount changed?
  • Did the guarantor sign a new undertaking or amendment?
  • Were form and any spouse-consent requirements satisfied?
  • Does the claimed debt arise within the covered period?

Leaving the apartment early is another separate issue. See leaving a rental property early in Turkey.

7. Duration: the agreed period and the ten-year rule

Article 598 provides that a natural person’s suretyship automatically terminates after ten years from formation, subject to a legally valid extension or new guarantee. This statutory rule is distinct from a shorter agreed scope or duration.

An extension under Article 598 requires a declaration satisfying the suretyship form. It may be made no earlier than one year before expiry and may extend the period for up to another ten years.

Ten years is not automatic rental coverage

A guarantee limited to a defined rental period does not acquire ten years of coverage merely because Article 598 exists. Identify the covered debt, agreed period, formation date and any later valid declaration.

Time-limited and indefinite guarantees also have specific rules under Articles 600 and 601. Older undertakings, legal-person guarantors and existing proceedings require separate assessment. Do not treat the ten-year termination rule as an ordinary limitation period for every claim.

8. Does moving out or replacing the guarantor end liability?

Moving out, returning keys or proposing another guarantor does not by itself settle responsibility for earlier covered debts. Check the handover, remaining obligations and any express release.

If a replacement guarantor is accepted, record whether the landlord also releases the original guarantor and for which periods or debts. Avoid confusing acceptance of additional security with a release.

Article 598 also links the guarantee to termination of the principal debt. The file should therefore identify payments, settlements and any other event said to extinguish the covered obligation.

9. What should a guarantor check when a demand arrives?

  1. Identify the document: private demand, notarial notice, enforcement payment order or court paper.
  2. Preserve service records: keep the envelope, delivery details and receipt date.
  3. Obtain the undertaking: collect the complete lease, guarantee and annexes.
  4. Check validity: examine form, handwriting, consent and authority.
  5. Map the claim: compare each amount and rental period with the guarantee’s scope.
  6. Check credits: reconcile payments and relevant security records.
  7. Respond through the proper route: do not assume a message to the landlord is a formal procedural response.

A possible invalidity defence does not mean official papers can be ignored. A payment order addressed to a guarantor may require a different assessment from the tenant’s rent-and-eviction notice.

See unpaid rent enforcement notices in Turkey for the tenant-focused guide; do not transfer its deadline summary to a guarantor’s document without checking the procedure.

10. Example: a claim for a later rental year

Assume a friend signs as guarantor for an Antalya apartment. The tenant remains after the initial year, and the landlord later demands rent from the extended period.

Review the handwritten particulars, any required spouse consent, the covered period and amount, and whether a later valid undertaking exists. The fact that the tenant continued living in the apartment does not answer all those questions.

This is a hypothetical example, not a client matter or a prediction of a legal outcome.

Documents to prepare for legal review

Formation and validity

Complete signed lease, guarantee, annexes, handwritten entries, consent documents and any authority to sign.

Duration and changes

Renewals, amendments, later guarantees, rent changes, releases and replacement-security arrangements.

Debt and payments

Itemised rental periods, bank records, receipts, deposit documents and explanations of additional charges.

Procedural records

Demands, service envelopes, enforcement file details, objections and court documents.

Retain original-language documents alongside translations. For foreign guarantors or people outside Turkey, initial review may begin remotely: remote legal representation in Turkey. Foreign nationality should not be assumed to remove form requirements or extend procedural deadlines.

Frequently asked questions

Is signing the lease as guarantor always enough?

No. Written form, handwritten particulars and any required spouse consent must be checked against the complete undertaking.

Which particulars must the guarantor write by hand?

Article 583 requires the maximum amount and guarantee date in the guarantor’s own handwriting. Joint and several status or equivalent wording must also be handwritten where applicable.

Does every married guarantor need spouse consent?

Written consent is generally required before or at formation, but statutory exceptions exist. Their application must be checked for the particular transaction.

Does joint and several status create unlimited liability?

No. It affects the conditions for pursuing the guarantor, but does not remove validity requirements, the maximum amount or the undertaking’s scope.

Does the guarantee automatically cover renewed rental periods?

No. Review whether later periods were validly covered and whether the exposure was sufficiently defined by time and amount.

Does a rent increase automatically increase the guarantee limit?

No. Compare the increased rent with the undertaking and maximum amount. Changes increasing the guarantor’s responsibility must satisfy the applicable form requirements.

Does the ten-year rule mean I guarantee ten years of rent?

No. Article 598’s rule for natural persons is separate from the debts and periods actually covered. A guarantee may have a shorter or narrower scope.

Can an individual guarantee be extended beyond ten years?

Article 598 permits an extension subject to its timing and form requirements, for a new period of up to ten years. Lease renewal alone is not that extension.

Am I released when the tenant moves out?

Not automatically. Check earlier covered debts, handover records, the undertaking and any express release.

Does accepting a new guarantor release the old one?

Not necessarily. Record whether the original guarantor is expressly released and which debts or periods the release covers.

Can a guarantor be charged for furniture damage?

First assess the tenant’s underlying liability, then whether the valid guarantee covers that obligation and amount.

Can I ignore enforcement papers if the guarantee seems invalid?

No. Preserve the papers and service records and obtain prompt advice about the appropriate procedural response.

Legal framework and official sources

This guide provides general information, principally about personal guarantees given by natural persons for rental obligations. Corporate guarantees, older undertakings, cross-border arrangements and ongoing proceedings may require a different analysis. Case decisions must be read in their factual and temporal context.
