Unpaid Rent Enforcement Notices: What Foreign Tenants Should Check

An official payment order for unpaid rent requires prompt attention, even if you believe the rent was paid or cannot read the document. Identify the enforcement procedure, establish the service date and check the claim before deciding whether to object, pay or take another procedural step.

Identify the document

Find the enforcement office, file number, form type and any eviction warning.

Check service

Preserve the envelope, delivery record and any electronic notification information.

Compare the claim

Match each claimed rental period with the lease, bank records and any payment receipt.

Choose the correct response

A message to the landlord is not the same as a formal objection filed with the competent authority.

1. Is this an enforcement payment order or a landlord’s demand?

A landlord’s email, a notarial warning and an enforcement payment order are different documents. Look for the enforcement office name, file number, parties, amounts, legal warnings and the heading ödeme emri. Verify authenticity through official channels rather than relying only on contact details or bank information contained in a forwarded message.

Rent and eviction: Örnek 13

This form concerns the special rental enforcement procedure. Check whether the creditor requested eviction and whether the payment order contains the necessary warning.

Money-only enforcement

A general payment order, commonly Örnek 7, is a different procedure. Do not apply the residential 30-day warning period to it merely because the claimed debt concerns rent.

A court judgment, an eviction order or enforcement based on an eviction undertaking also requires a separate assessment. The title of the document and the underlying file must be checked together.

If the claim concerns an undertaking rather than unpaid rent, see disputing the signature or date on an eviction undertaking in Turkey.

2. Establish the service date before calculating a deadline

The document’s issue date is not necessarily its service date. Keep the envelope, postal record, notification slip and any electronic service record. Establish who received it, at which address and by what method.

Do not assume that a deadline begins only when you personally read the papers. Service through another legally recognised method may have effects even when you were absent. Electronic service has its own rules; an email alert or the date you opened a message may not establish the legal service date.

If you think service was defective

Record when and how you first learned of the file and obtain prompt advice. A service complaint and an objection to the debt are distinct procedural matters. Alleging defective service does not automatically suspend the file or remove the need to address other deadlines.

Article 32 of the Notification Law addresses actual knowledge following irregular service. The appropriate complaint, evidence and timing must be assessed rather than treating the notice as something that can simply be ignored.

3. Separate the objection period from the payment warning period

For an ordinary residential rent-and-eviction payment order, the usual seven-day objection period concerns challenging the enforcement claim. The 30-day residential warning period concerns payment and the consequences of default. Article 315 of the Turkish Code of Obligations provides the residential warning framework.

These periods should be calculated individually from the legally relevant service date. Their commencement, final day and any applicable holiday rules should be verified. Agricultural leases, other tenancy categories and different enforcement forms must not be assessed using this residential summary.

Do not wait for negotiations to finish

A promise that the landlord will “check the bank account” is not confirmation that a statutory period has stopped. Obtain advice and complete any necessary formal step while settlement discussions continue.

If the objection period has already passed, seek review immediately. The remaining options depend on the procedure, service and circumstances; a late objection does not automatically have the effect of a timely one.

4. Match the claimed debt to the lease and payment evidence

Prepare a month-by-month comparison. Identify the rental period, due date, contractual amount, amount paid, recipient and payment reference. A transfer needs to be connected to the claimed obligation.

  • Parties: are you correctly identified as the debtor, and is the claimant entitled to demand payment?
  • Rental periods: are the months correct, duplicated or already paid?
  • Rent amount: does the claim reflect the applicable contract and lawful increase?
  • Currency: are currency and any conversion assumptions explained?
  • Ancillary expenses: what contractual and legal basis supports each charge?
  • Interest and costs: check rates, dates, enforcement expenses and legal fees separately.
  • Credits: identify acknowledged payments, refunds or any alleged set-off.

Do not assume that every sum labelled a “cost” is irrelevant to eviction. Ancillary charges require careful review of their character, the lease, the warning and the applicable law.

If payments were made in cash, preserve receipts and complete correspondence. See paying rent in cash in Turkey and proving payment.

5. What does an objection challenge?

Depending on the facts, issues may concern payment, the amount, the claimed rental periods, the underlying agreement or another procedural matter. An objection must reach the competent enforcement authority through an accepted method within the applicable period. Retain proof of filing.

In the rental procedure, objections to the lease itself or a signature have specific requirements. An objection to the debt does not necessarily amount to an express denial of the lease or signature. Only raise a denial that accurately reflects the facts.

A timely objection generally stops the challenged enforcement in the applicable procedure, but does not finally decide whether money is owed. The creditor may pursue the legal route for overcoming the objection. Partial objections require particular care because the undisputed portion may be treated differently.

Why there is no universal objection template here

A generic “I object to everything” message may fail to address the relevant issues or may make an inaccurate statement. The document, lease and payment records should determine the response.

6. If paying, check the amount, recipient and effect on the file

Obtain a current file calculation and verified payment instructions. Distinguish the rental debt, any relevant ancillary obligations, interest and procedural costs. Do not assume that paying an approximate figure settles every issue.

If payment is made directly to the landlord, preserve clear proof and ensure it is brought to the attention of the enforcement file through the appropriate procedure. A transfer alone may not result in the file being marked satisfied.

Timely payment of the obligations relevant to the default warning can affect an eviction request based on that default. Payment after the warning period does not automatically have the same effect. Remaining costs and file closure also need separate confirmation.

A repair claim or deposit dispute should not be treated as permission to withhold rent without assessing its legal basis. Related guidance: emergency repairs and cost claims and rental deposit refunds in Antalya.

7. Does receiving the notice mean immediate eviction?

An Örnek 13 payment order is not itself a completed eviction decision. The landlord must satisfy the conditions of the applicable procedure and pursue the necessary legal steps. Nevertheless, failure to respond or pay within the relevant periods can materially affect the tenant’s position.

Check the creditor’s request, the warning, service, any objection, payment records and subsequent court papers. Negotiating over the amount does not make those documents unimportant.

8. What should foreign tenants check about language and overseas residence?

Arrange a reliable translation or legal explanation promptly. Do not assume that limited Turkish, foreign nationality or the use of an English lease automatically extends a procedural deadline.

If you are outside Turkey, the service method and address records need particular attention. Service abroad may depend on the country, applicable treaties and the person’s status. Foreign citizenship alone does not determine whether international service was required.

  • Send all pages and both sides of the envelope for review.
  • State where you were living when service occurred.
  • Provide the date and method by which you learned of the papers.
  • Check whether an appointed lawyer or authorised representative received service.
  • Arrange any required representation documents promptly.

See remote legal representation in Turkey and power of attorney for foreign clients. Preparing a power of attorney does not itself stop a deadline.

9. Will mediation stop the enforcement deadline?

Do not assume that settlement discussions or a mediation invitation replace an objection. Article 18/B of Law No. 6325 provides mandatory mediation for many tenancy lawsuits, while expressly excluding the statutory provisions concerning eviction through enforcement without a judgment under Law No. 2004.

Whether mediation is required for a particular subsequent claim depends on the route chosen. Address the payment order’s procedural requirements separately.

10. Example: paid rent and a missed objection period

A foreign tenant in Antalya receives an Örnek 13 notice claiming two months’ rent. The tenant has bank transfers and asks the landlord to correct the claim, but waits because the notice mentions a 30-day payment period.

The essential review is whether the seven-day objection period is still open, whether service was valid and how the transfers relate to the claimed months. The longer payment period should not be mistaken for extra time to object.

This hypothetical example illustrates a procedural risk, not a client matter or a prediction of the outcome.

Documents to prepare for urgent review

  • The complete payment order, attachments and service envelope.
  • The enforcement office name, file number and available file records.
  • The lease, amendments and rent-increase correspondence.
  • Bank statements, transfer confirmations and cash receipts.
  • A month-by-month payment comparison.
  • Correspondence about rent, expenses, repairs or settlement.
  • Any filed objection, payment after notice or subsequent court document.
  • A short timeline stating service, actual knowledge and later actions.

Frequently asked questions

Do I have 30 days to object to an Örnek 13 payment order?

No. In the usual residential procedure, the objection period is generally seven days. The 30-day payment warning period serves a different purpose. Verify the document and service date.

Is every rent payment order an Örnek 13 notice?

No. Rent may be pursued through different procedures. Check the form, file and whether eviction is requested before applying a deadline summary.

Does a message to the landlord count as a formal objection?

A private message is not a substitute for an objection submitted to the competent enforcement authority through an accepted method. Keep proof of any formal filing.

What if I already paid the rent?

Match the payment records to the claimed periods and obtain prompt advice about the correct procedural response. Having payment evidence does not by itself stop the enforcement file.

Does not speaking Turkish extend the deadline?

Do not assume that it does. Arrange translation and legal review promptly, while checking the service record and applicable procedure.

What if I was outside Turkey when the notice arrived?

Review the address, service method, receipt records and actual knowledge date. Overseas residence does not automatically invalidate service or suspend deadlines.

Can I ignore a notice if service seems defective?

No. Service objections have their own procedure and timing. They should be assessed alongside any required response to the debt claim.

Does a timely objection end the dispute?

It generally stops the challenged enforcement in the applicable procedure, but does not finally determine the debt. The creditor may pursue further legal steps.

Will paying the landlord automatically close the enforcement file?

Not necessarily. Verify the amount, preserve payment evidence and ensure the payment is properly reflected in the file. Costs and closure need separate confirmation.

Can I use the deposit instead of paying the claimed rent?

Do not assume the deposit automatically settles rent. The agreement, security arrangement and legal basis for any set-off need review.

Does the payment order itself evict me?

No. An Örnek 13 payment order is not itself a completed eviction decision. It can, however, lead to further enforcement and court steps if the legal conditions are met.

Can I arrange a review from abroad?

Initial review may be possible remotely. Send the complete papers immediately and arrange any required authority documents without assuming that preparation stops deadlines.

Legal framework and official sources

This article provides general information, principally about residential rent enforcement. It does not calculate an individual deadline or replace review of the payment order and service record. Different documents, tenancy categories and procedural stages may require different action.
