Subletting an Apartment: Landlord Consent and Short-Term Rental Risks
Letting someone use your Antalya apartment while you are away can involve more than an agreement about rent. Identify whether the arrangement is a sublease, a transfer of use, a replacement tenancy or a short-term rental activity before handing over keys or accepting bookings.
Identify the arrangement
Check who occupies the property, who pays whom and who contracts with the occupant.
Check written consent
Confirm the landlord’s approval, its scope and the authority of anyone signing for the landlord.
Review short-term rules
Check the rental duration, permitted operator and applicable permit requirements or prohibitions.
Preserve the records
Keep agreements, consent, listings, payments, inventories and official notices.
1. Subletting, sharing and transferring the lease are different
In a sublease, the original tenant enters into another rental arrangement with an occupant. A transfer of the tenancy is different: it concerns replacing a party in the main rental relationship. Article 323 provides a separate written-consent framework for that transfer.
A guest visit, a paid room arrangement and repeated short-stay bookings should not be treated as identical. The actual terms, possession, payment and operation matter more than the label chosen by the parties.
- Will the original tenant remain in the apartment?
- Is the occupant paying for a room or the whole property?
- Who signs the agreement and receives the money?
- What is the actual length and purpose of the arrangement?
- Are multiple occupants or bookings involved?
Calling the arrangement “house sitting” or “cost sharing” does not settle its legal classification. An unpaid arrangement may also require assessment if it transfers the right of use.
For the general tenancy checklist, see renting property in Turkey.
2. What should written landlord consent cover?
Obtain and review consent before proceeding. Approval for a named person to occupy one room is not necessarily permission to operate repeated whole-apartment bookings.
- Property: the address and permitted room or whole apartment.
- Occupant: who may use the property and whether substitutions are allowed.
- Period: the agreed start and end dates.
- Use: the specific residential arrangement approved.
- Responsibilities: rent, expenses, damage and handover arrangements.
- Authority: who gives consent and whether they can bind the landlord.
Do not rely on silence or an agent’s informal assurance
Preserve the complete written record. Whether a particular electronic communication satisfies the required form should be assessed. An estate agent’s approval is not automatically the landlord’s consent.
Landlord consent, a tourism rental permit and building-owner approvals answer different questions. One does not substitute for the others.
3. Short-term rental rules include stays of exactly 100 days
Law No. 7464 excludes rentals made for more than 100 days at a time from its stated scope. The implementing framework addresses rentals of 100 days or less; exactly 100 days is not outside the threshold.
The regulatory definition is not confined to holidaymakers. Calling a short stay a business visit or temporary residence does not by itself remove it from the framework.
Why “101 days” is not a universal solution
The contract must reflect the actual arrangement. A longer term on paper does not remove the landlord-consent requirement or establish compliance with every other applicable rule.
Repeated contracts exceeding 100 days
Article 4(1)(g) contains a specific administrative sanction for renting the same dwelling more than four times within one year from the date of the first contract, despite making each rental contract for more than 100 days.
This does not mean that four rentals are automatically lawful. The actual activity and all other legal requirements still need review.
In Antalya, seasonal demand and accommodation-platform bookings make these distinctions particularly relevant. Platform acceptance does not establish legal authorisation.
4. A residential tenant cannot simply obtain consent and become a short-stay host
Article 3(7) of Law No. 7464 prohibits a tenant who rented a property for their own residential use from re-letting it for tourism purposes to third parties in their own name and on their own account. It also prohibits users from independently re-letting a property rented from a permit holder.
The law contains specific exceptions and operating arrangements, including provisions concerning legal-person users’ employees and qualifying high-quality residences. These should not be assumed to apply to an ordinary apartment tenancy.
The statutory definition of the lessor concerns ownership or specified property rights. An ordinary lease and permission to sublet do not automatically give a tenant that status under the permit framework.
Consent does not override the statutory prohibition
Before listing, check who contracts with guests, whose name the permit bears and who operates the activity. Owner authorisation is not, on its own, proof of a lawful operating structure.
5. Building approval and permit conditions require separate review
The ordinary apartment permit framework includes building-owner approval requirements. Different provisions may apply to qualifying residences and other property configurations.
A building manager’s informal approval is not automatically the required owners’ decision. Review title information, the management plan, building configuration and current application rules. A marketing description such as “residence” does not establish an exception.
Ministry guidance directs permit applications through e-Devlet. Check the permit’s relationship to the specific property and operator before relying on a document supplied by another person.
6. Subletting does not automatically release the original tenant
Article 322 addresses the original tenant’s responsibility where the subtenant uses the property beyond the use granted to the tenant. The main lease and agreed obligations remain important.
An occupant’s payment to the tenant is not necessarily payment to the landlord. Keep separate accounts for the main tenancy and any permitted sublease. Record inventory, keys and condition at each handover.
For condition disputes, see furnished rental inventories and damage claims in Antalya. For payment evidence, see proving rental payments in Turkey.
Can unauthorised subletting lead to eviction?
Unauthorised activity can create a tenancy breach dispute. Termination and eviction depend on the legal basis, required notices, facts and procedure. Neither immediate eviction nor a right to continue should be assumed from the allegation alone.
See tenant eviction matters in Antalya for information about legal assistance.
7. Lease disputes and administrative sanctions are separate risks
Private tenancy dispute
The landlord may allege breach of the lease or claim a remedy. Consent, permitted use, damage, notices and the appropriate termination or eviction procedure need assessment.
Administrative compliance
Authorities may assess prohibited or unauthorised rental activity under Law No. 7464. Permit rules, the operator, contracts and the relevant conduct matter independently of landlord consent.
Resolving a private disagreement does not automatically remove an administrative issue. Likewise, holding a permit does not settle every obligation under a lease or building arrangement.
This guide does not reproduce fixed fine amounts. The applicable sanction and any annual adjustment must be checked for the violation’s date and category. Depending on the provision, the number of dwellings or contracts and continued activity can affect the assessment.
Permit compliance may also involve identity reporting, advertising and operational duties. Lease permission is only one part of the review.
8. What if the apartment has already been listed or booked?
- Preserve records: save listing versions, bookings, agreements and payments.
- Identify the structure: establish the contracting party, operator and actual arrangement.
- Review authorisation: assess consent, permits and their scope.
- Avoid unsupported commitments: obtain advice before accepting further bookings.
- Address existing customers: assess cancellation, refund and contractual obligations.
- Handle notices promptly: retain official papers and service records.
Removing a listing does not by itself resolve earlier activity or existing bookings. Preserve evidence before making changes, and do not alter dates or inaccurately describe the arrangement.
If an administrative decision arrives, check its issuer, legal basis, notification date and stated challenge route. Do not assume the deadline or competent authority is the same as in a tenancy claim.
9. Example: an Antalya tenant travelling abroad
Assume a tenant plans to leave a Konyaaltı apartment for six weeks and accepts paid stays from several visitors. The landlord has written that “subletting is allowed.”
Review what that consent covers, who contracts with each visitor and the short-term framework, including the prohibition on specified tenant re-letting. Landlord approval alone does not answer those questions.
This is a hypothetical example, not a client matter or a prediction of a legal outcome.
Documents to prepare before proceeding or responding to a complaint
Main tenancy
Lease, annexes, subletting clauses, written consent and evidence of signing authority.
Rental activity
Actual occupancy dates, contracts, contracting parties, payments, listings and booking records.
Property and permits
Available title details, management plan, owners’ decisions and any claimed permit.
Dispute records
Complaints, notices, inspection records, official decisions and notification dates.
Keep a chronological list of contracts and actual stays, including activity during the year following the first relevant contract. Preserve original-language documents alongside translations.
Foreign nationality or being abroad does not automatically remove applicable duties. See remote legal representation in Turkey.
Frequently asked questions
Do I need written landlord consent to sublet an apartment?
Article 322 requires written landlord consent for residential subletting and transfer of the right of use. Check the scope and form of the actual consent.
Can I rent out only one room without consent?
Do not assume that partial subletting avoids the requirement. The room arrangement, main lease and written consent need assessment.
Is a guest visit automatically a sublease?
No. Assess the actual arrangement, including payment, possession, duration and any transfer of use. Labels alone do not decide the issue.
Does landlord consent make short-term hosting lawful?
Not by itself. The tourism rental framework has separate permit rules and prohibits specified forms of tenant re-letting.
Does the short-term framework include exactly 100 days?
Yes. The framework covers rentals of 100 days or less. Rentals made for more than 100 days at a time are outside the law’s stated scope, but other rules remain relevant.
Does a contract exceeding 100 days remove every rental risk?
No. The actual arrangement, landlord consent and other applicable rules still matter. Article 4(1)(g) also addresses renting the same dwelling more than four times within one year from the first contract despite each contract exceeding 100 days.
Does calling a stay a business trip avoid the rules?
Not automatically. The implementing definition is not limited to holiday travel. The actual rental arrangement must be checked.
Can a residential tenant independently re-let to short-stay guests?
Article 3(7) of Law No. 7464 prohibits specified tourism re-letting by residential tenants in their own name and on their own account. Ordinary subletting consent does not remove that prohibition.
Is the building manager’s approval enough for a permit?
Do not assume so. Check the required owners’ decision, property configuration and applicable permit rules.
Does acceptance by an accommodation platform prove legality?
No. A published listing or accepted booking is not proof of landlord consent, permit compliance or a lawful operating structure.
Am I released from the main lease when a subtenant moves in?
Not automatically. Subletting is different from transferring the tenancy, and the original tenant’s obligations must be reviewed.
Does unauthorised subletting mean immediate eviction?
Not automatically. The legal basis, notices, circumstances and applicable procedure need assessment. It can nevertheless create a serious tenancy dispute.
Does settling with the landlord remove an administrative issue?
Not automatically. Private tenancy remedies and administrative compliance are separate matters and require separate assessment.
What should I do if bookings have already been accepted?
Preserve the records and obtain a review of consent, permits, the operating arrangement and existing customer obligations before making further commitments.
