Emergency Repairs in a Rented Antalya Apartment: Notice, Invoices and Cost Claims
Emergency Apartment Repairs: Notice, Invoices and Cost Claims
Water is spreading across the kitchen floor. An electrician identifies a dangerous fault. A technician says a failed component needs immediate attention. You arrange the work, pay the bill and then discover that the landlord disputes responsibility.
A repair invoice shows a charge. It does not, by itself, establish who must ultimately pay. A supported claim connects the defect, urgency, notification, necessary work and payment to the rented apartment.
This guide explains how tenants in Antalya can preserve repair evidence and distinguish reimbursement, rent reduction and deduction of repair costs from rent.

Can a Tenant Claim Emergency Repair Costs?
Potentially. Responsibility depends on the cause of the defect, necessary work, notification and legal basis for recovery. Keep the technician’s findings, itemised bill and payment evidence.
Article 306 of the Turkish Code of Obligations provides a route to have a defect remedied at the landlord’s expense after requesting repair within an appropriate period and the defect remaining unremedied.
Where immediate intervention cannot wait, document that necessity. Urgency alone does not make every expense recoverable or permit an automatic rent deduction.
Safety, Responsibility and Recovery
- What must be done immediately to prevent harm?
- Who is responsible for the underlying problem?
- How should any cost claim be pursued?
For the wider framework, see our landlord and tenant law services in Antalya .
Use qualified help for immediate hazards.
Describe the defect and retain the replies.
Record why the work and timing were needed.
Review costs before changing rent payments.
Who Pays for Repairs in a Rented Antalya Apartment?
Article 301 requires the landlord to deliver and maintain the premises in a condition suitable for the agreed use. Article 317 places ordinary cleaning and maintenance expenses on the tenant, taking local custom into account.
Allocation requires a diagnosis, not simply a price. A costly call-out may concern tenant-caused damage; an inexpensive part may correct a defect for which the landlord is responsible.
Possible Landlord-Side Defect
An ageing fixed installation, underlying leak or fault in equipment supplied with the tenancy may require assessment under the landlord’s obligations.
Maintenance or Tenant-Caused Damage
Routine servicing, misuse or accidental damage may point to a different allocation. Identify the cause and relevant maintenance history.
What About Air Conditioning or a Water Heater?
Establish whether the equipment belonged to the landlord and formed part of the rented apartment. Ask the technician to distinguish routine maintenance from deterioration, installation problems or misuse.
Cooling failure during an Antalya summer may materially affect occupation, but high temperatures alone do not automatically justify replacing an entire unit. The diagnosis, agreed use and circumstances matter.
Inventory and move-in records help identify what was supplied. See our guide to renting property in Turkey for document checks at the start of the tenancy.
What Should You Do When the Repair Cannot Wait?
For fire, serious electrical danger or another immediate threat, contact the appropriate emergency service or qualified professional. Avoid hazardous work yourself. Evidence collection should not delay necessary safety action.
Making Safe and Permanent Repair Are Different Decisions
Stopping an active leak or isolating an unsafe appliance may be immediately necessary. Replacement, decorative work and upgrades may allow time for inspection, quotations and agreement.
- Ask which measures are needed immediately.
- Keep the emergency scope as specific as possible.
- Contact the landlord and record attempts to reach them.
- Discuss further work once the immediate risk is controlled.
Does an Emergency Remove the Usual Repair Requirements?
Do not assume so. Article 306’s repair-at-the-landlord’s- expense route is framed around a request and an appropriate opportunity to remedy. If intervention occurred without that opportunity, its necessity and the legal basis for recovering the expense must be assessed separately.
The review should identify whether the work protected the landlord’s property, whether instructions could realistically be obtained and whether the chosen scope went beyond immediate protection.
Explain why waiting was impractical: record continuing damage, the technician’s findings, contact attempts and the measures taken. The need to act immediately and the right to recover a particular amount are separate questions.
How Should You Notify the Landlord?
Article 318 requires prompt notification of defects the tenant is not obliged to remedy. Failure to notify can create liability for resulting damage.
Address the notification to the landlord. Include the managing agent where relevant, while checking their authority. Reporting the problem only to a caretaker may leave uncertainty about the landlord’s knowledge.
- Identify the apartment and affected installation.
- State when the defect appeared and its current effects.
- Attach safe photographs and any diagnosis.
- Request inspection or repair and propose access.
- Describe immediate containment already undertaken.
How Long Should You Allow for Repair?
Article 306 refers to an appropriate period rather than a fixed number of days for every defect. Active flooding and a non-urgent fitting problem should not automatically receive identical treatment.
Follow telephone contact with a factual written summary. Retain complete messages and replies. For disputed responsibility or significant expenditure, obtain advice about a formally documented notice.
Record the agreement precisely: acknowledging a defect, approving a contractor, accepting a quotation and agreeing to a rent deduction are separate decisions.
What Could an Initial Repair Notification Say?
The following illustrates a factual communication. It is not a completed legal notice or a universal template for asserting a reimbursement right.
“At [time/date], I discovered [defect] at [address]. It is affecting [area/use] and may cause [specific further damage]. I attach photographs and any available technician’s findings.
Please confirm how you will arrange inspection and repair, and when a technician can attend. Because [specific urgency], immediate safety or containment work may be necessary.
I have already taken [steps]. Please confirm the contractor, scope, approved budget and payment arrangements. I will retain the work records, invoice and payment evidence.”
Tailor the requested response time to the situation. “Send a quote” should not be interpreted automatically as permission to replace equipment and deduct the entire price from rent.
Foreign tenants should preserve original correspondence alongside translations.
What Should Repair Records and Invoices Show?
Connect the defect, attendance, work and payment. A generic invoice entry such as “maintenance” may leave the reason and scope unclear.
Diagnosis and Necessity
- Technician’s identity and attendance date.
- The installation or equipment inspected.
- Observed fault and likely cause.
- Necessary repair and possible alternatives.
- Why delay mattered, if urgency is claimed.
Work and Payment
- Accurate property or job reference.
- Itemised labour, materials and call-out fees.
- Completion date and service report.
- Correct customer and supplier information.
- Reliable proof of the amount actually paid.
Does the Invoice Establish Payment?
Not necessarily. Match it with the bank record or payment acknowledgement. If another person paid, record their identity and the arrangement with you. Request accurate documents rather than altering invoice details to strengthen a claim.
Preserving the Condition Before Repair
Keep original photographs of the problem and completed work. Ask the technician to identify removed parts before disposal where practical; do not retain dangerous materials.
If substantial work will erase disputed evidence, obtain prompt advice about formal evidence preservation. Necessary safety intervention should not wait for that process.
How Can You Show That the Repair Cost Was Reasonable?
Paying a bill does not establish that every item was necessary or reasonably priced. Explain why the contractor and selected repair were suitable for the problem.
Where Time Allows, Obtain Comparable Quotations
Compare the same scope: diagnosis, parts, labour, warranty and call-out charge. A quotation for temporary containment cannot fairly be compared with one for complete replacement.
- Send the proposed scope and price to the landlord.
- Keep approval of any material changes.
- Ask why replacement is preferable to repair.
- Separate improvements from restoring existing function.
What If There Was No Time to Obtain Several Quotes?
Multiple quotations are a practical evidential measure, not a universal prerequisite for emergency assistance. Record why comparison was impractical, who was available and how the price was explained.
Keep emergency fees transparent: identify night attendance, immediate call-out or specialist charges separately. Their necessity and reasonableness may still be disputed.
Can You Deduct Repair Costs from the Rent?
Article 306 provides a deduction route where its conditions are satisfied. It does not authorise subtraction of every repair bill simply because the tenant paid it.
Review responsibility, notification, opportunity to remedy, necessary scope and the supported amount. If a deduction is agreed, identify the exact expense, rental period and remaining rent payable.
A disputed deduction may become an arrears allegation: the landlord may challenge the amount or legal basis and pursue unpaid rent. Evidence adequate for one type of claim may not satisfy a different procedure.
Where substantial sums are disputed, consider the options for a separate reimbursement claim before changing payments. Do not ignore official notices while negotiating the repair bill.
For the consequences of a payment-related eviction demand, see our tenant eviction legal services in Antalya .
Are Reimbursement, Rent Reduction and Damages the Same?
No. Separate the requests and avoid counting the same loss twice.
Repair-Cost Reimbursement
Identify necessary expenditure, the basis for recovery and the amount paid. Exclude unrelated upgrades from the repair account.
Reduction for Affected Use
Article 307 concerns proportionate rent reduction for defects affecting use, from the landlord’s knowledge until remedy. Document the impact and relevant period.
Additional Losses
Damaged belongings or temporary accommodation need separate proof of loss, causation and liability. Keep receipts and explain necessity.
Ending the Tenancy
Serious defects can raise termination questions. Review severity, notice and the opportunity to remedy before treating the tenancy as ended.
Departure following a serious defect differs from an ordinary early move. Our guide to leaving a rental property early in Turkey explains related remaining-rent and notice issues.
What If Repairs Require Access or Building Management?
Article 319 requires the tenant to tolerate work addressing defects or preventing damage, while requiring appropriate notice and consideration of the tenant’s interests.
Agree the attendance time, personnel, affected areas and supervision. Repair arrangements should not be treated as unlimited permission to enter the home. See our guide to landlord entry without permission in Turkey .
Shared Pipes, Roofs and Other Apartments
Ask the technician to identify whether the source lies within the apartment, another unit or a common installation. Notify the landlord and relevant building management.
A caretaker approving access does not necessarily authorise expenditure on the landlord’s behalf. Common-area work may require separate approval and cost allocation.
Insurance and Payments by Others
Record insurer, neighbour and building-management payments. Distinguish your outlay from sums paid by others and amounts already refunded.
How Should You Request Reimbursement?
- Set out the chronology. List discovery, notification, replies, attendance and completion.
- Explain the cause and necessity. Link the diagnosis to the supplied equipment, installation and lease records.
- Itemise the supported amount. Separate containment, permanent repair, optional work and sums already reimbursed.
- Attach the evidence. Include notice, relevant images, findings, quotations, invoice and payment record.
- Specify the requested arrangement. State the amount and repayment method. Obtain clear confirmation of any negotiated adjustment to rent.
Illustrative Example: A Leak in Konyaaltı
A tenant reports an active leak. A plumber performs immediate containment, then quotes for permanent repair. The landlord later disputes part of the bill.
The review separates urgent attendance, necessary replacement and optional finishing work. It checks the notification, instructions, price and payment for each stage.
This is a hypothetical illustration, not a reported client case.
What If Payment Is Refused?
Preserve the reason for refusal. A dispute about cause requires different evidence from a disagreement about price. Rental lawsuits generally require prior mediation under Article 18/B of Law No. 6325, subject to the statutory exception for the specified non-judgment eviction procedure.
Assess the intended claim and any separate official response deadline. If costs later appear as deposit deductions, compare the accounts and see our guide to rental deposit refunds in Antalya .
What Should You Bring to a Repair Dispute Consultation?
Connect the Defect to the Requested Remedy
Prepare the lease, inventory, incident chronology, landlord’s replies and contractor records. Identify what remains disputed and the amount you seek.
Include rent-payment records and any official papers if a deduction has led to an arrears allegation.
For tenants in Muratpaşa, Konyaaltı or elsewhere in Antalya, retain Turkish originals alongside translations. If you are abroad, our guide to remote legal representation in Turkey explains initial document review and representation arrangements.
Emergency Repairs in Antalya: Your Questions
Does the landlord pay for every repair?
No. The cause, ordinary maintenance, tenant-caused damage and equipment supplied with the tenancy need assessment.
Should I notify the landlord before arranging work?
Notify promptly and seek instructions where circumstances permit. If immediate safety work cannot wait, record its necessity, contact attempts and the technician’s findings.
Does an emergency automatically create a reimbursement right?
No. Immediate intervention and recovery of its cost are separate questions. Responsibility, necessity, scope and the legal basis for the claim must be examined.
Is there a fixed waiting period for every repair?
No. Article 306 refers to an appropriate period. The nature and seriousness of the defect matter.
Does an invoice guarantee reimbursement?
No. It supports the expense but does not alone establish responsibility, necessity, reasonable cost, notification or payment.
Must I obtain several quotations in an emergency?
Multiple quotations are not a universal requirement for emergency help. Where comparison is impractical, record why and retain an itemised explanation of the price.
Can I deduct the repair bill from the rent?
Article 306 provides a deduction route where its conditions are met. Review the basis, amount and evidence first; an unsupported deduction may create an arrears dispute.
Is rent reduction the same as repair reimbursement?
No. Reimbursement concerns expenditure; rent reduction concerns affected use during the relevant period. Each needs supporting facts.
Who pays when the air conditioner fails?
Check whether it was supplied with the tenancy and whether the fault concerns maintenance, deterioration, installation or misuse. Obtain a diagnosis before allocating the cost.
What if the leak comes from a shared pipe or roof?
Notify the landlord and relevant building management. Obtain a diagnosis identifying the source and preserve authorisation and payment records.
Can I claim temporary accommodation costs?
Such costs require separate assessment of necessity, causation, amount and liability. A receipt alone does not establish entitlement.
Can I request review after leaving Turkey?
Initial review can often begin remotely. Preserve originals and send the complete file, including official papers and their receipt dates.
